;D DO IT DUDE....you aint got nothing to loose.When you win the will do all the leagal stuff to garnish his wages an so forth.He has 30 days to contest the courts decision.If he doesn`t it is legal an binding an then it goes on his credit report as a judgement.Until that is satisfied it will affect him on any thing he tries to buy on credit.Also he cannot renew his licensence till that also is satisfied.
How i know is that i went through the same thing where i got a judgment for 2550 an he wasnt gonna pay, 2 years later got a letter in the mail lets resolve this.He got poped for driving on a suspended license an he has to clear this up so he can get it back otherwise he gets a hefty fine an jail time.
So take him to small claims.Or the tv court because in the long run you will get the money for your car.As you said you dont want it back.Also file a sale with the dmv so you dont get stuck with the to an impound of a car thats still in your name.......
