If you have a WON than it could be one of your neighbors connecting to yours. I'm on wireless also and their are 3 others around me that are unsecured
that I can use and do ----, but MINE is secured

Yes, that's what the provider guy was trying to scare my wife with. I called him and he tried to give me the same story and once I asked if a proxy server or virus could do the same exact thing, he shut up and agreed. The problem with the neighbor scenerio is that this was on craigslist in a completely different state, and I can't think of why the neighbors would care to defame anyone in another state. It had to have been someone tapping into my IP through another means.
The internet provider also tried to scare my wife with "If someone goes on your network and downloads porn, you're responsible for it". When he brought that story up with me, I asked if that precident had been set in court before, and he said he didn't know. Well, if it's never happened in court before, then don't tell my wife we're responsible when you don't have a clue. ::)

Anyway, looks like I'll have to fork out cash to have my information held from the court. Oh yeah, and justice for all. :X

How many different ways can someone tap into my IP address, and does it automatically change at any given time, because the IP that I have now isn't the one listed on the complaint that they say was mine. ???

How are you checking your ip address? You local ip (192.168......) is different than the one other people see on the internet.

It depends on how your service provider does things. Mine is Charter, and I keep the same ip address.

GENERALLY
DSL = dynamic, changes from time to time, so other people may have leased the same IP, although i'm sure its logged when you got it, and when you got a new IP
Cable = as far as i'm concerned its static, i've had the same IP for 6+ months, not sure, probably much longer
regardless, i'm sure they log when your modem gets a new IP.

I'm not sure about other ISPs, but some lease an IP for each user for a day or more. You will keep that IP unless they need it for some reason, or if you restart your modem (and in a lot of cases you'll just get the same one back). They do keep records of what person was leased what IP. I think they said it's required by law, and I can't remember how long. Maybe a month?

I just went to some check your IP site and it wasn't the one listed on the complaint. Right now my options are:

- Pay a lawyer a couple hundred to write a letter on my behalf and tell them that I oppose them having my information. This could be later overturned if they have hard evidence against "my" IP, leading to a lawsuit anyhow.

- Call the plaintiffs lawyer as John Doe (all they know me by right now other than an IP) and explain to them that I couldn't have possibly gave a ---- enough about defaming someone in another state that I don't know, and hope they drop it.


From what I've gathered, finding someone guilty of defamation is one of the hardest things to do because of the first amendment. I would have to ------ a lie that I knew for a fact wasn't true to be guilty of anything, and proving that someone knew it was a lie is hard enough, let alone throwing in the mix not even knowing the person or living in the same state. Sounds like a fishing expedition for lawyers.
