Tickets: Trial by declaration. What should I say?

Re: Tickets: Trial by declaration. What should I say?
Well you dumb ---- yes it does. I know plenty of people who have gotten out of tickets. I know a guy that told them he just had a new transmission put in and they didn't connect the speedo sensor. If you go in stuttering and looking around like a dumb just trying to get out of a ticket it won't work. Speak clearly and look them straight in the eyes.

Re: Tickets: Trial by declaration. What should I say?
Do people still not know the best methods to get out of a ticket with points?
1) See if you can take a driving class to drop the points. Make sure you check with your insurance company if this will drop the points from there too. If it doesn't, then don't bother with it. Points on your license are meaningless unless you are an awful driver. You only care because the points get applied to your insurance as well and end up costing you a lot of money. In NJ we have some of the highest insurance rates so it is a big deal when you get points on your license. In other states I don't know if it is as big of a deal, but here if the ticket is $200 and 3 points we'll end up paying $1000+ over 3 years in extra insurance charges. It's no joke.
2) If you can't do 1, get a lawyer. For traffic cases they aren't that expensive. Make sure you get one that will only get paid if they get your sentence reduced to no points and a moderate fine. They will go talk to the DA and most likely the points dropped and you will pay about 2-3x the ticket cost. On top of that you will have some lawyer fees. Typically, this is less expensive than paying the ticket plus all of the insurance surcharges. The only downside is you need to come up with a decent amount of cash up front instead of paying it off over time with insurance surcharges.
3) Talk to the DA yourself. Cut out the lawyer. If the DA is a dick, they will blow you off and you will have to hope the judge is forgiving. It is always better for the state to increase the fines and give you no points because they make more money that way but judges don't really care. The DAs do. Your best bet is working with them.
As for lying/faking ----, well that is perjury. I wouldn't suggest it. Any judge with any sense will see that you are trying to lie to them and throw the book at you. 10 over isn't a big deal. Typically you won't get a ticket for 10 over, especially when you are in a 55 zone and it was just 65.

Re: Tickets: Trial by declaration. What should I say?
I just won my case via trial by declaration. To sum it up, put that you were not traveling at the speed alleged by the officer and you were traveling at a safe and reasonable speed. Also note that you were traveling with the speed of traffic.

I just realized that this was only 10mph over. Just offer to plead guilty to a lesser speed like 5mph over.
Some insurance companies will let that slide. I don't know how the points would work though, MN doesn't have points.

make sure when you go to court, you wear one of those t shirts that looks like a tuxedo, then they know you mean business. a briefcase leaking booze helps too.
seriously though i wouldnt even worry about that if your record is decent, i got a 114mph ticket lowerd to 98 and a small fine and nothing happened. dont even talk to your insurance company and dont admit anything to the state attorney or whatever that guy is that gave me the deal, if thats how it works where you are

you are going to cost yourself more money by trying to fight it.
pay the fine now and move on with your life.
if you go to court you have to take off work (losing money) and you'll have to pay court fees(usually more than the original ticket is)

agreed^
the last ticket i got for speeding i paid my lawyer 150 dollars for his fee then found out that since the ticket was issued by a state trooper that there was nothing he could do because it was at the state level or some ---- so i ended up paying the fine and taking 2 points. Also if the officer asked you how fast you were going and you told him 65 then your fucked, you need to go to your states DMV website and look at your options, some states offer traffic diversion courses which means you pay 120 dollars and if you don;t get anouther ticket in 6 months they drop the whole thing.
or you can get a lawyer pay twice whatever your fine is and not worry about anything, or you can be retarded and try and convince the judge that your innocent just like the 100 other people in front of you that he just dealt with.
