The seller has not responded to any of my emails.

I keep asking him stupid questions, like:
"When is the best time to pick up my new car?"
"Do you have any more pictures of my car that I could see?"
"Would you prefer a certified cheque for $305 or should I paypal you the $305?"

My last message to the seller came back with a message:
Delivery Status Notification (Delay)
Guess he doesn't want to hear from me anymore.

Looks like I'm going to Paypal him the amount, then get one of my best friends (who happens to be a lawyer) to email him and send him a letter on the company letter head....just to stir the pot a little bit :)

Anyone here live close to Richmond?

He has refused the Paypal payment:

Message From Seller:
I have stated that there is NO SHIPPING AVAILABLE ON THIS ITEM!!
I will do a full refund on this transaction. The car will be sold to my another
buyer."

I sent him an email:
"I have purchased this car and I am making arrangements to come pick it up. THERE IS NO OTHER BUYER as the car rightfully belongs to me. The auction was a binding contract and I will take action legally to obtain the car."

Shut up ::) The guy was a dumbass/douchebag/jagoff/idiot/---- (take your choice) for not setting a reserve, so it's his own damn fault for not putting one on or ending the auction early. Also its his legal and moral obligation to sell the car to Ihatedomestic, as much as it hurts to take a loss.

The fact is, I don't really care if I get the car or not...I'm just fighting because technically the car *should* be mine...and the guy was an idiot for posting the car without a reserve (and not even in Ebay motors). If I really wanted to, I'm sure there is a legal way of obtaining the car, but that requires money I simply don't have.

I did finally hear from the guy though:

"Buddy, I am not selling my car anymore. And look, this is not my e-mail. If you want to talk. e-mail me at bchiu@....

I have do a full-refund and that's the best I can do for you. I have ask E-bay to cancel to bidding 4 days ago, they did not do it in time. So your binding contract is really not in effect. I have all the records and e-mail regarding closing of the bidding.

"If you forward the emails from ebay, I'll back off. If not, I'm coming to pick the car up and will have my lawyer and/or the police in tow if required."

I'm just trying to make him sweat a bit, maybe he'll learn his lesson.
