talked to the insurance,I get 500 bucks, period. Im not allowed to sue either. This is BS. BUT, my boss is giving me a sweet deal on parts and paint. I get them at shop cost, and he's letting me use the shop and tools to fix it for free, so Im looking at about 400-500 bucks now. Hopefully it will stay under 500 so it doesnt cost me anything other then aggrivation and my time to fix it.

Depending on how bad it is, the paint will cost you $200 alone + parts = you are fucked.

Why can't you sue, is the insurance company making you sign a waiver or something like that. ---- that. You can sue anyone you want, doesn't mean you will win, but you can sue. You can sue an individual, sue the person that hit you not the insurance company. Hell I can sue you for making me mad, I'll probably lose but I can still file the suit.

Florida is a if you hit from behind you lose state, and it doesn't matter if you where not the one at fault, like if someone hit you from behind, he's responsible for your car, but if he moves you and you hit the one in front of you, it's your fault for following too close. Bullshit in a way but it works.

Call one of those accident attorneys, the first call is free and they can tell you if you have a case or not, most of those, the insurance pay the attorney's fees, so you won't lose anything but a few phone calls. Do it.

Its a state law, Im not allowed to sue. Im michigan, your insurance fixes your car, and your car only if you have collision insurance. I only have liability, so the only thing my insurance covers is if I kill/maime someone. Thats all. I already talked to several insurance places to verify, and they all said the same thing. Im getting all teh work/materials done at a huge discount, like 30% of what its supposed to cost. Granted, I have to do all the work, but Im not going to complain.

I want it fixed ASAP. Looking at it pisses me off and makes me want to kill something. I dont know why I didnt beat the ---- out of him before the cop got there and then left, It woulda been about the same deal for me, but I sure woulda felt better. :y ;D

Take him to civil court and file a tort (a civic grevance of personal injury to body or property). Invoke the moton for strict liability and go from there.

In Alabama if you hit someone in the rear Regardless of the circumstances it is your fault. UNLESS you can prove that they had no working tail lights ;)

sucks if you hit someone, great if you get rearended.
