Got rearended today, need advice...
 

hi guys, I need advice. I was stopped on a city street, in a line of cars, 4th car back, and a big assed dodge ram truck slid into the back of me. To make a long story short, he ended up bending the ---- out my my trunklid, shattering the bumper, rear reflectors, and bending the part of the unibody that the trunk latch catches on (1996 ford escort 2 dr. hatch). The body shop I work at said 1400 bucks, and thats cutting corners. Another body shop says 2400 bucks. I live in michigan and we have gay assed no fault here, which means that Im pretty much fucked since I dont have comprehensive, just liability. the guy was from wisconsin, and his truck is registered there to. It *LOOKS* like form michigan's website, that since he's from out of state I can sue him for the damages, but I was wondering if anyone on here is from Michigan and can provide me with advice.... he looks at me face turns red tells me like it or leave it. i told the lady.. and quit..

mostlikely you will have to sue..

things you should have gotten from him were driver liscence number, vin number off the truck. and plate number

there are MANY lawyers here that would be willing to take your case up for free..

ill guage it. maybe i can help you find the parts for dirt cheap too..

you will need plenty of pictures for court anyways.. also take pictures of the intersection where you hit..

and PLEASE tell me you waited for the police to come so they could file a police report :-\

Don't fix it...I mean...it's a Ford Escort the guy was doing you a favor. Sue him if his insurance doesn't pay for it and get a better car.

I've got picutres, ad a phone number, and yes, teh police came and filed a report. IVe found all the parts I need for under 400 bucks but paint is whats going to kill me, and I do work at a body shop. ;D

Who cares about paint..look at my avatar ;D That sucks man, your state must really be gay with insurance, wouldn't that consider your car totaled and then insurance pay you for it or anything...I mean 96 escort isn't worth much (no offense, just the truth) My gf rear ended a blazer and I fixed her 98 zx2 for about $500 it was kind messed up but there was tons of parts in the yard for it...I'd say sue the dude see what money you get and if enough just buy a new car...why go through th hassle of fixing it unless you have to...get anther escort and then you have a spare motor for when you turn up the boost!! >:D

its worth about 1800 bucks.. Im a month away from turboing this thing finally after 2 years of saving cash for parts... If I come this close and then have to buy a new car/shell out half of it to get it fixed, Im gonna kill soomething. :7

you work at a bodyshop and they stiffed u when you wanted to fix ur car at the shop :P

talked to the insurance,I get 500 bucks, period. Im not allowed to sue either. This is BS. BUT, my boss is giving me a sweet deal on parts and paint. I get them at shop cost, and he's letting me use the shop and tools to fix it for free, so Im looking at about 400-500 bucks now. Hopefully it will stay under 500 so it doesnt cost me anything other then aggrivation and my time to fix it.

Depending on how bad it is, the paint will cost you $200 alone + parts = you are fucked.

Why can't you sue, is the insurance company making you sign a waiver or something like that. ---- that. You can sue anyone you want, doesn't mean you will win, but you can sue. You can sue an individual, sue the person that hit you not the insurance company. Hell I can sue you for making me mad, I'll probably lose but I can still file the suit.

Florida is a if you hit from behind you lose state, and it doesn't matter if you where not the one at fault, like if someone hit you from behind, he's responsible for your car, but if he moves you and you hit the one in front of you, it's your fault for following too close. Bullshit in a way but it works.

Call one of those accident attorneys, the first call is free and they can tell you if you have a case or not, most of those, the insurance pay the attorney's fees, so you won't lose anything but a few phone calls. Do it.

Its a state law, Im not allowed to sue. Im michigan, your insurance fixes your car, and your car only if you have collision insurance. I only have liability, so the only thing my insurance covers is if I kill/maime someone. Thats all. I already talked to several insurance places to verify, and they all said the same thing. Im getting all teh work/materials done at a huge discount, like 30% of what its supposed to cost. Granted, I have to do all the work, but Im not going to complain.

I want it fixed ASAP. Looking at it pisses me off and makes me want to kill something. I dont know why I didnt beat the ---- out of him before the cop got there and then left, It woulda been about the same deal for me, but I sure woulda felt better. :y ;D

Take him to civil court and file a tort (a civic grevance of personal injury to body or property). Invoke the moton for strict liability and go from there.

In Alabama if you hit someone in the rear Regardless of the circumstances it is your fault. UNLESS you can prove that they had no working tail lights ;)

sucks if you hit someone, great if you get rearended.
