Down with Ground Dynamics...Please help me out
 

Alright I posted this long ago with no results. For those of you who do not know, a body kit manufacturer is using pictures of my car to advertise their product. My kits not made by them and I'm not getting anything for this either.

The website is http://www.grounddynamics.com If you go to body kits then pontiac sunfire the first graphite color one is mine.

Anyways here's what I'd like. Everyone call the company and piss them off with repeated calls, emails... if your in the area rocks would do just fine.

It might be a lot to ask from you guys but I'd appreciate any help I can get. i cannot afford a lawer so this is the last resort. The main concern is that I modified this kit especially the side skirts from www.andysautosport.com (I flared them out to match the bumper) anyways so what the customer see's and gets are two different things. Plus I'm not getting anything which isnt helping

Yep thats exactly what they did. They probably got them from another forum for jbodies that I'm part of. If you try to right click on their pictures of my car it says they are protected by their copyright, how ------ gay is that.

Yes I've tried contacting them, I always get a damn secretary and no response. I've sent emails and filed a complaint with the BBB.

I figured many calls would at least piss them off and maybe they'ed remove it.....

I don't know what you can do about that except sue them in small claims court.

If you have the proof that you took those pictures of YOUR car, you can proove that they copyrighted material that did not belong to them.

I seriously doubt that they have copyrighted anything because they used your pics off the net.

You might be entitled to a portion of their profits on the sales of that body kit.

But before that happened they would remove the pics.

At least ask a lawyer if any laws have been broken by them. If so, then you may be able to get more.

so far, I have left 4 messages and e-mailed then 47 times (just kept pressing send ;D) I put in the mail that I bought that kit and it looks nothing like the kit in the pic. I told them that there's looked like hell and that was not the kit in the pic. I also told them that They could be sued for false advertisement. I also went on the main website for the car club I'm in and posted a front page bulletin of the bullshit that happened to ya. My crew are also leaving e-mails and messages ;) We got ya back!

Just chatted with the some of the guys from the club. so far the total tally on our part is 462 mails and 39 messages! damn, they must have a huge mailbox. oh well, guess we will just keep em' coming to it finally reads FULL!
I would be a damn shame to have your mailbox full so that customers couldn't leave messages or send mails to order stuff now owuldn't it? ;D

The picture of the black sunfire must be taken off of your website. You have copyrighted pictures that you do not ownership of. This is a breach of penal code 28765437.987 if these pictures are not removed from your website legal action will be taken. You have been reported to the BBB for this offense and also because of a related offense pertaining to false advertisment due to the fact that my client did not buy the body kit in question from your company and has done custom work on it making the kit you are advertising different from the one you are selling. You will be contacted by mail regarding the legal action to be taken if the pictures are not removed within 7 days.

Thats cool that someone might be able to do that but please do not put "airtonics" or my name anywhere on there. I dont want them attempting to sue me for damages because thats just my luck.

Hahahaha I just talked to the guy on the phone. What a royal faggot.

I was directed to him by a secretary, sounding all professional she got scared.

Anyways, this guy says to me after I explained the situation "yeah we dont give a ---- because this guy is being an -------. We think he is gay."

Me "So that justifies the illegal use of pictures as well as your false advertising?"

Him "Yeah, hes an ------- and he should just come down here so we can kick his ass. He can't handle anything in person."

I really cant afford suing them right now plus on the the otherside of the US which doesnt help.

Regardless thats certainly not a way to do business. Hey if my emails and calls worked the first time they wouln't be getting all that ----.

Don't worry bro, no names on any of it. anyways he has just about got it! You guys are going to laugh your ass off when you see what is taking that pics. place.......he found the energizer bunny ------- some guy but the guys head is turned away abd right above that guys head he wrote "owner of ground dynamics" with an arrow pointed at the guys head! now thats funny but what makes it even better is that when the pic is clicked on, the audio then comes on and says he keeps going and going and going..... ;D

Small claims court is very inexpensive.

I think if you file a case in your county, he will have to travel from where he is.

Of course he would have to be served papers for the summons to appear.

Just making him appear in court would be enough for me.

And if he doesn't appear, you will win a judgement against him.

Be sure to get proof of what he's doing before he changes it. Save it to a disc or something.
