So back about a year and a half ago my now ex decided she needed a loan to pay for moving expenses and first months last months rent. She needed a cosigner and I was put on the spot and fucked up. We had been dating for 4 years so seemed ok at the time.

Well we broke up and bitch quit paying the loan. The loan is at my banking institution so they have taken $600+ out of my account with another $900 to go. So needless to say I'm going to sue her ass. My question is do I sue for the $600 or the full amount? If I sue for the $600 and they keep taking it out do I have to resue later?

People at the court house are useless as "They aren't allowed to give any leagal advice"

It's called a cosigner for a reason. I wouldn't waste your money on taking her to court cause of you being the cosigner of the loan. You just be out that much more for paying for lawyer and still having to pay off the rest of the loan.

WRONG! Did you construct a loan agreement, if so get on that, read the fine print. Go to the bank and work with them, they are there for you. This happens all the time, or someone dies and someone either borrower or co-signer is left with tons of debt.

"When you're asked to co-sign, you're being asked to take a risk that a professional lender won't take. If the borrower met the criteria, the lender wouldn't require a co-signer." Thats the first mistake you made.

Second if you didnt make a loan agreement your double fucked. Regardless, talk to her, ask her wtf her deal is. She still pissed or something, tell her to grow the ---- up and pay for her ----.

Third, YOUR CREDIT IS FUCKED! FUCKED! Unless you are paying it :X, their might be missed payments though.

Damn Doug never knew about this. Whole point of the co-signer is so they have a second person to rape if they aren't getting their money. There's really not ---- you can do except threaten with a lawyer and hope for the best.

There's a free forum (or few) for legal advice. I'd look for one and see what is possible.

you're a cosigner for a reason they don't have you on the loan just so they can tell you when shea not paying it. The whole point is because she had shut credit and they needed someone else that can siphon the money from when she defaults. You can try to take her to small claims court and you won't need a lawyer I know in ct it only costs 35 bucks to file a claim. You'll still have to make the payments until then. If you win and she can't
Pay you can have her pay attached.

Do like Corey said, go to small claims and get a judgement against her. When she gets a house or other real property the judgement attaches itself to the deed and whenever it sells you get your money plus 8% interest - ------- solid investment right there.

I know first hand that even tho there is nothing that the military could do to the new hubby, it would sure put some fear in him to be asked by his First Sergeant why there are civilians calling the base about his wife's debts. It will either motivate him to pay you off, or beat you up.

That said, I really like the JD small claims court idea. You get to serve her ass with papers, present your case, and get a judgement against her. That's some serious satisfaction right there. Just make sure you have your documentation up to snuff, and be respectful of the judge. Best case is where she doesn't show up and you win by default. Don't forget to include the paper service fee included in the judgment.

I'd say you have a 50/50 chance winning in court. Depends on the judge really. Legally you are both equally responsible for the loan. There is a chance the judge will be sympathetic to your case and say she is actually responsible to pay you back some percentage. Again, it's completely the judge's discretion. I'd give the bitch a call or send her an e-mail. Do it nicely(the non-hmt way) at first. See where it gets you. Get meaner the more she fucks you. Don't do a call-a-thon or anything like that because if you go to court, you will look like a white trash piece of ----. Remember, if you are going to try to make a case, you have to look like the responsible adult and she has to look like an immature irresponsible dumb ass.

I say take the bitch to small claims court via Judge Judy or Judge Mathis or some TV show... I see it all the time. If she even made payments towards the loan its acknowledged that it was a loan. The fact that yall broke up and she married someone else is in ur favor at that point.

I've seen this type of case so many times on TV court. You just gotta have proof of the things u need. Even though u co-signed for her, you loaned her money in faith of her repaying it. And don't forge anything. If there's a paper trail ur good to go

So I send her a message saying she need to contact me, blah blah blah, need it repayed, blah blah blah. Being nice and civil. Then I sent her husband one also. She sends one back saying she's not paying it, it's in my name also and it's my fault for not moving in with her and helping her like I said I would (which I never did, but she says she has whitnesses). So I tell her she will or I will be filing court papers on Mon. and if I win and they don't pay will set it up to garnish hers and his wages. She then says I can't touch his wages (dumb bitch), she's going to contact his CO and cops and say I'm harrassing them, and take me to JAG (Too much TV kids).

Anyways, so long story short I'm going to file the paper work tomorrow. Even if I loose I'm taking her sorry ass mom to court over a car they didn't pay for and will pay it off with that. Oh well live and learn. After the case a HMT call a thon might be in order.

So for shits and giggles I applied to Judge Mathis. I kept getting "unknown" number phone calls and didn't answer. Checked v-mail and had a message from a producer. Called him back he asked all the nitty gritty and said it sounds like a case they are interested in. He said they have to contact her and have her agree to be on the show however. Man I hope she does lmao. I still have to file a case in small claims, but they hear it and rule. Said you get paid $100 for being on too.
