im getting sued.
 
ok so on may 10 05 i was delivering a pizza (yes i work for pizza hut) to west fort hood when a lady in a 95 for explorer slammed her brakes on. i hit mine and slid into the back of her. i fucked my car up bad, i had to raplace fenders, hood (now i have the gay hood), bumper, radiator, headlights, corner lights, and windshield. all it did to her truck was turn the left side of her back bumper a little, hardly even noticable. so her insurance company (gieko) was on the phone with me in less than an hour after the wreck. i wasnt given a ticket, but i was told the wreck was my fualt. that was the last i heard about the wreck. i fixed my car the next day, and went on with life. a couple of days ago i got a call from my insurance company saying the lady is sueing them for some ----. her husband is military, so i know she didn't pay anything out of pocket and didn't get any bills for that ----. nine months later!! and my insurance company doesn't know that i deliver, otherwise they wouldn't cover me. she told them i was delivering. someone told me the worse that can personally happen to me is i get dropped from my insurance, but i got a certified letter in the mail saying if i don't coopperate with them im getting all the bills.

I thought Pizza Hut also had insurance on their drivers?

At least that's how I remembered it when I drove for them. That's why they do a license check before you get hired. :y

is she suing you cause she was hurt? i had that happen but i never actually got sued. i would just cooperate with the insurance company. how did you not get a ticket? you were following too close and you were at fault. was there an accident report made?

I got sued once. took care of it person to person, left the insurance out of it I made a deal with her lawyer. so maybe you can try to speak to her lawyer

my manager sucks. he has a copy of my license, my insurance and all that ----, but he never told me about needing some special insurance. he never said anything about them having insurance on me either. the lady was fine. she even had a lkid in the car- who was completely fine. they were more worried about my car than them. the police didn't give any tickets, and i was told i was at fualt becuase i hit her from behind. i was about three car length behind her doing maybe 40-45 mph. i never told my insurance company about it cuz i fixed my own car and didn't want my rates going up. $85 a month is pretty cheap

get legal assistance if you can, since her husband is in the military she has free legal assistance, and these military lawers love to see what they can do. so dont be the victim of someones training. ask a lawer what you need to do, or since its the insurance company that got sued see what they want to do.

yeah my mom is pretty good with all that law ----, so im going to talk to her the next time i see her. i don't know what to do though till then. my insurance called my and kept trying to get me to admit that i was working at the time of the accident. i wouldn't say yes or no, just that i couldn't remember. i was working at the time, but i don't know if i should tell them.

just keep it that way. I got out by saying it wasn't me ;D to the police, they drop the charges, but my car was proven guilty, so I pay the victim and kept my licence

i got sued 2 years and 10months after an acciednt i had, and they were sueing me for $250k, wtf!?!?! so i was like, whatever, i have no assets, lol and it went to court for about 15min and the judge threw it out, lol

haha thats not why it was dropped, she was sueing me for some bullshit reasons, like whiplash, inability to work, inability to have sex (im not even kidding on that one), mental anguish, ect...

I just went through this with my son,If she is sueing u for neck,back,titties or even her vagina, she has to have some kind of medical records to show that she went to a doctor and that the accident caused this pain or BS and 9 months later coming after you. I beleive if there was no accident report or ticket given she cant come back to try and collect money call a lawyer for free consultation

yeah apparently it isn't here lawyer. its a chiropracter she went to that wants to get paid. the military won't cover chiropracters, so she had to pay, told them to get me.

If she only went to a chripractor your in the clear courts DO NOT concider them in the medical field they are concidered a luxuary . In order for her to challange she must have a legitimate doctor who has examened her and refered here to a wanna be doctor. this is what the court told me when my son was sued

Talk to your insurance agent. They are there to represent you to work for you with the insurance company. If you go to court your agent is on your side, not the insurance companies.

If you don't have an agent, then get a lawyer.

In all of my accidents the insurance covered my chiropractor visits ??? And how is a chiropractor a wannabe doctor?

Are you being sued by the lady for pain and suffering and damages OR by the insurance conpamy for not telling them your where driving for pizza hut and they want to make you pay for the damages?

Im assuming your refering to back pains, alot of people swear that back pain is just a figment of the mind i guess u could say brought on by sress and ----. I really dunno what to think but no one really knows for sure. My mom though couldnt even hardly walk for two years because she had a stabbed/pinched nerve from a chip of bone in her back and then and even now after surgery if somethin stressful happens her back begins to get sore..........weird ----

My chiro has fixed my back problem, my bad knee (pinched nerve), and effectively stopped my tendonitis in my right leg. Also one time got rid of my headache.

I would find out if Pizza Hut has to carry some kind of insurance for you and for driving. -do it behind there back though. Send an email to a corporate person and ask but put the email in the "my son is delivering pizzas and our insurance doesnt wanna carry him because......(blah) and then say "does pizza hut carry anything" then sue pizza hut for not giving you insurance.

What exactly are you being sued for?

im not exactly sure what im being sued for yet. so far my insurance company hasn't told me ----, except that she has been seeing a chiropracter. they just wanted to collect info and ask why they are just now finding out about it almost 9 months later. im going to check if pizza hut has insurance on me or not, and if they don't im going to see about that ----.

ok check this out. In the United States, delivery services whose employees use their personal vehicles must carry non-owned, hired auto insurance. The insurance protects the business operator from liability in accidents that occur while the employees are working.

According to insurance brokers, nearly every insurance policy for personal drivers prohibits the use of one’s vehicle for delivering goods for a business, and many policies specifically state no pizza delivery. Jim Reichle, co-owner of Angelina’s Pizza in North Olmsted, Ohio, suspects that very few pizza delivery operations have non-owned, hired auto insurance. That not only endangers the public, he said, he believes it compromises his ability to compete fairly against those pizzeria operators.

When drivers apply at Angelina’s, Reichle follows his insurance company’s guidelines to screen each applicant’s driving record. If those applicants have more than two moving violations and one at-fault accident in a 36-month period, he can’t hire them to drive.

"What winds up happening is that those drivers simply walk down the street, get hired by one of my competitors and sometimes are put on the road the same day," said Reichle. "I pay more than $15,000 a year to cover the drivers at both of my shops, and that leaves me with $15,000 less than another guy to use for marketing if I wanted. Basically I’m getting penalized for playing by the rules." Reichle said two issues are at work regarding non-owned auto insurance: Many pizzeria owners aren’t aware they must have it, and many others who know it's mandatory don't buy it.


So does that mean pizza hut is required to have insurance on me? and if they do, would that help at all with my insurance company saying i was driving my car when i signed something saying i wouldn't?

DON'T admit ---- too the insurance company. When I got in an accident with my jag, I didn't admit to guilt or anything and they labeled me as the guilty party, ---- AAA. As for the accident, there was no report so just lag out the playing stupid and get a lawyer. I dunno what else to say cause I was coming up with things as I was reading, but now forgot them all :-\

lol oh well as ive said in other posts, im a poor mother fucker. i make like $250 everyother week. so if they really want to sue me they can, but there not getting much.

ok. first off you need to get some damn details.

1. WHO is sueing you? Did the lady just complain to your insurance? Or is the ladies insurance sueing your insurance?

2. WHAT is she sueing for? Medical bills? Pain and suffering? A chiroprator is only payable by claims upon reference by a LISENCED doctor. She just cant go ouchy ouchy chiro here i come.

3. DO NOT tell your insurance you were delivering. Does anyone have proof that you were on the job, or can you simply get by saying i was on my way HOME from work.

4. Time to talk to Pizza Hut about this non-owned insurance BS, if they say "oops, oh ya" tell them to lawyer up for you.

ok i talked to my claims adjuster yesterday and i still didn't learn much. the lady i hit told her that i took a pizza hut sign off of my car after the eccident, so i can't lie about that. i think its the lady sueing me for money to pay her chiropracter. im still not sure. my boss is a twat so im going to have my mom call him top secret like ---- and ask about insurance on the drivers. she is going to say she is thinking about applying for a job.

From the article you posted it sounds like pizza hut is liable if they don't have you covered under insurance. It says its mandatory for them to have insurance on their drivers and it kinda sounds like they can't even have you deliver pizza in your personal vehicle. So if you do get sued you should just turn around and sue pizza hut's ass. This is a crazy world we live in.

So anyways, yeah, cross all of your T's and dot all of your I's. Let the bitch sue you. Remeber, she isnt sueing you for your money, shes sueing for the money that you pay with your insurance payment every month. If you look in your insurance policy it will have some sort of injury amount of $$. that is the money she is sueing for. Each state is different with the amount your required to hold. I think in Indiana (my state) its like $150K... some states like Texas I think its a high as hell amount of $$. (i know this because at my last duty station, we had to carry at least $250k) -but yes, its an obsurd amount of $$. thats why shes sayin hes had all of this loss. -neck, back and so on...and its 9 months past the fact. shes done her homework. I guarantee it.

OK, so after shes sued you, then you sue pizza hut for not doing there part. According to that article, they are suspossed to have insurance on you, which is why your insurance company is wanting to know if you were at work. See how that works ;)

Also, I would go to a lawyer and sit down with him and ask for his opinion and what your obligated to, and what pizza hut has to carry. It might cost you some out of pocket $$ but it will be worth it in the end.

IMO, you could become very wealthy from this according to that article.

only thing that will happen her insurance sus your insurance tthats y you have insurance she cant sue you directly for that unless you had no insurance her insurance will sue yours and get a what is called a minitort basically 500 bones to cover the deductable and thats all that will be done.

and about the pizza hut thing yeah they do have insurance on their drivers or they wont put their name on your car thats y they need yourinsurance and ---- you should get ahold of your insurance and make sure all that is happening is that they are paying out the minitort being no injuries and no tickets were given out she cannot sue you she has nothing to sue for

This is what I would do, find her address, grab a Crayon and write her this letter:
Dear Lady,
If you sue my daddy he wont beable to pay for my cancer treatment and I will die. But at least I'll be in heaven with mommy.
