Defamation of character, slander, libel

http://www.exeterpolice.org/press1.htm

All kids from my school, except the bottom one. All of the kids had to throw away their college futures. Very sad story, and pathetic for the cops to brag about. I wonder is that defimation of character, slander, or libel? I always thought it was innocent until proven guilty. Not guilty until proven further guilty. Also doesnt everyone have the right to a fair trial. Thanks.

Re: Defamation of character, slander, libel

What are you talking about? The kids were arrested for those things. They are over the age of 18 so it can be posted/reported by anyone as far as I know. It doesn't say they were found guilty. It is simply saying what they were arrested for.

Re: Defamation of character, slander, libel

3 of them were not 18, so I don't see how they got away with posting names/charges.

Either way, even though I don't agree with pot prohibition (if that's what they were charged with), they were aware of the consequences.

Re: Defamation of character, slander, libel

if im not mistaken anyone over the age of 16 can be posted up in the paper and such on arrest charges.

and that is neither libel nor slander. first off slander is oral defamation so thats out. libel is written defamation. the only way it could be either of them is if it wasnt true. thats what libel and slander are, flase statements about a person that hurts thier reputation.

the kids are shitbags dealing drugs in high school. who cares. i highly doubt any of the loser were going to college anyways.

Re: Defamation of character, slander, libel

You dont need to be 18 to be charged as an adult.

Which one is you BTW?

Is it libel if you make MS Paint pictures of a picture you find on the interweb?

lol...thats not the cops "bragging," its them reporting that they are doing their job. Selling/having drugs at school isnt exactly the fast track to college either. If they are your friends just hope they get good lawyers, and dont go doing what they did lol.

Re: Defamation of character, slander, libel

It's not slander if it's true. But the posting of names and pics (especially in this case together) for kids under 18 is BS.

Re: Defamation of character, slander, libel

All of the charges were for marijuana related issues. The problem I have is what if a lawyer finds the evidence gathered by the police was illegal and the case gets thrown out, anyone (colleges) can look and see that he was arrested and appears to be convicted of the crime. If you call busting kids, police work, then the chief of police shouldnt get paid 100k. Also none of those kids are myself, they are all kids I have known since kindergarden. Also the police will not release and property (marijuana) or physical evidence linking any of the individuals to the crime. In other words the cops call the kids house and say, "We have a warrant for your arrest, come turn yourself in." None of these kids have a lawyer at this point so they dont even know if the charges are real. In my opinion if a cop says you did something and you admit to it, you are convicted. Regardless if the cop has evidence or not, you admited to the crime. Also there are plenty of other criminals in this town that are, "more hardcore," and their pictures do not appear anywhere.

Re: Defamation of character, slander, libel

they got caught...it is not the fault of the police. Even if that wasnt posted online there is still a record of their arrest that I'm sure any college could find. I got arrested for something stupid a few years ago, I didnt blame the cops afterward (although it was the last day of college so it didnt really matter much lol). I didnt pay much attention to their charges but you never know, they might still get into college if it gets reduced.

Re: Defamation of character, slander, libel

Where are earth did I say its the cops fault. You guys put that together in your own heads. Obviously its not the cops fault. The kids made a mistake, it doesnt make them more of a criminal than anyone else arrested. Furthermore I dont think their faces should be put up on the net without ever other person arrested for equivalent crimes on there aswell. Quite bitchin, I never said it was the cops fault, the kids made a bad decision I just dont think the police should make it even harder for the kids to overcome the charges.

what colleges actually do backround checks, let alone deny people for having been arrested?

and they got thier pictures put up there to prove a point. how many kids at your school are gonna think twice about dealing drugs now? if they see what will happen it will deter them from doing it. tell your buddies to stop being losers and get a real job. sure they might have been applying to colleges but they probably would have fucked off the whole time and failed/dropped out.

On the flip side, I have applied to several of places. I applied at a starbucks in stop and shop, and all they wanted to hire was middle aged women b/c lots of thefts were occuring by male employees. I applied at a garden center, but they wanted someone full time and sooner than when I graduated, I am now going to apply at autozone. :6

i guaranty its there first offense.. the most that will happen is community service/probation and a fine. thats about it. very unlikely it will go any further then that.

Wrong! I hate to rant and rave about this more, but the cops in this town are extrodinarily hard. I was arrested when I was sixteen because, a senior robbed my house and stole marijuana. I went after him with a car load of kids with like three baseball bats, mase, and a knife in my trunk. I never got in a fight only one senior that was my friend got in a fight with one of the other seniors that robbed my house. The cops came and several of us were arrested. I got probation, community service, and 3 counsoling classes, I even spent close to 3 grand on a lawyer. At the end of my trial I felt lucky. Another story, I got pulled over with two of my friends, I was the passenger the cops found a bowl, no weed, and the kid confessed it was his, I got to walk cause I had nothing to do with it, I wasnt high and neither of the two were, they got a lawyer and both had to pay an excessive fine, do community service, probation, and the counsoling classes. All of us were under 18 at the time. I could go on and on. The cops here are known the be assholes. They are verbally aggressive to every person in town, young or old.

wow, sounds like you got it real hard there :S

Paying fines, doing probations is getting it easy.

First offenses always get it easy. It mostly depends on the amount of drugs tho.

i wonder...when i got arrested, there were people from my college waiting for me to be released, to tell me that i was banned from campus until it was resolved (was the last day of school anyway). I said "well what if I'm innocent?" and they said it didnt matter, and i was banned until i went before some council or something. I wonder what wouldve happened if it was in the middle of a semester or something.

Birdley42008 03-14-2008 01:44 PM

Re: Defamation of character, slander, libel

Drinking on the bus in 8th grade is a lot different than confronting someone that robbed your house.

Im just basing the hardness of the cops off the surrounding towns. If I live in a town over from mine it would be less of a penalty with marijuana cases. The reason my town is more strict is because, we have the Phillips Exeter Academy here. Kids come from all around the world. A lot of money is involved and they want good police in this town. Nothing wrong with that but theres always the ethical cop and the unethical cop. And I guarantee if you came to this town and expierenced the police you would agree that the abuse of authority is unreasonable. My physics teacher is a cop in Hampton, NH. Which is on the east coast and has several nice beaches. A lot of people from Mass come up to party and he knows that Exeter is a hard place for a teen to grow up in. Many people in this town have said as a joke, "When has it become a crime to be a teenager?"

Getting jail time is harsh. Getting stuck with some classes and fines is a slap on the wrist.

Re: Defamation of character, slander, libel

Oh that reminds me, my friend took a mini apple computer minus mouse, keyboard, and monitor and wires and he went to jail for 30 days. Also my friend got caught with 2 ounces of weed with intent to distribute and he got 60 days in jail brought down from 6 months.

Re: Defamation of character, slander, libel

Those are all felonies, of course they're gona get more than a slap on the wrist. Any type of felony will get jail time.

It's still not hard.

My dad was an apprentice to a drug mission about 15 years ago. He got 2 years in jail, all for giving my uncle a ride to deliver a few ounces of coke.

considering punishments are decided by the courts, i dont see how the cops being douchebags have anything to do with what kind of trouble they are in. they got charged with whatever crime they commited and the judge decides what kind of penalty they get.
