Calling All Members! Someone's Using my car on ebay

Well guys someone sent me a link to an ebay auction for body kits using my car as their advertisement. I woudlnt care so much except for the fact that My kit is not ground dynamics its andysautosport. Another thing is my side skirts are cavalier skirts and are flared out to match the bumper. I also altered the front and rear bumpers, especially the rear.

After looking at ground dynamics homepage I found my pics there as well...all with their watermark all over it.

I ask all HMT members to send some hate mail their way.

Anyways here are the links:

The ebay auction http://cgi.ebay.com/ebaymotors/ws/eB...tem=2439983174

This is their homepage you have to go to body kits and click on sunfire... http://www.grounddynamics.com/merchant/mainpage.htm

Can I act like one of your sponsors that's pissed off about my company being misrepresented as some kind of "cheap ebay company?" Signed StealthmodePerformance of course. ;)

Stealtmode I'm pretty sure they are aware they are knocking off andysautosport but you may do as you wish lol.....

Exactly. Whithout ripping pictures from everywhere, these guys would never have a catalog. You need reembersment for that. Let me see what kind of response I get from them. ;D

Re:Calling All Members! Someone's Using my car on ebay

How's this: :D

To whom it may concern,
It has come to my attention that your website contains photograph's of one Pontiac Sunfire in which my company has a sponsorship agreement. I have contacted the owner of this vehicle and made him aware that your website contained these photo's. He was unaware of the situation and has given no consent to the photo's or the watermark which is attached to them. We have also found these unauthorized pictures on ebay.
Furthermore, the Pontiac Sunfire in question has had hours of custom body work labor done to it which is also misleading your customers as to what they are purchasing. The suggestion that your customer will be recieving what is pictured, is not something the owner of this vehicle would like to be known for, nor my company. My company has spent great sums of money and time to create a reputation that is not easy to come by in this industry. I am sure you are aware of the investments we have made. Our reputation is something we strive on here at Stealthmode Performance, therefore, being associated with such websites as www.ebay.com is not in our best interest.
Thank you for your time, and as the base sponsor of the vehicle in your photo's, any responses should be directed towards my company.
Sincerely,
Stephen Smith
Stealthmode Performance ;D ;) 8)

Jeff,

Notify Ebay and demand that they take the auction down. They will usually do that if you are the owner of the product being sold.

that you are using my photographs to advertise your products. I also noticed
that the pictures were used right on ground dynamics homepage as well. I am
the owner of the sunfire and I did not give permission to use these photos
nor am I giving permission now. The body kit was not produced by ground
dynamics but was pieced together from andy's autosport and customized from
their design. That is simply misrepresentation along with copyright
infringement on my pictures. Regardless whether the pictures were posted
online or not just like any works the copyright need not be registered, I
took the photographs myself.

andysautosport and possibly take legal action if need be.

Wow thats wierd. I couldn't tell what you were all upset about at first because I got to the links too late, and they already changed the pictures.

Re:Calling All Members! Someone's Using my car on ebay

another thing is, why is he saying that grounddynamics.com gave him permission!?!? thats fucked up of them to give permission knowing its not theirs!! that makes their company look bad!! thats not a good way to do business, you can tell they are probably not so honest :-\

airtonics 10-29-2003 04:47 PM

Re:Calling All Members! Someone's Using my car on ebay

I've heard a lot of bad things about ground dynamics and this is not the first time they have done this.

The pics have yet to be removed from their homepage. To be honest its not Kevin (the ebay auctioner's) fault because he had no clue. Ground dynamics is using the photos to advertise their product its only natural he used them.

Trance if you look above and go to the ground dynamics homepage the pics are still up on his site...makes me wonder who the ebay auctioner ripped off now. I know I've seen that car before somewhere

the new pics have an extremedimensions watermark. There is no way he got "permission" from those guys. At least it's not your car anymore.

Re:Calling All Members! Someone's Using my car on ebay

I am from Rancho Cucamonga. I mailed the guy from the bodykit company, not the ebay guy. I haven't recieved anything from this douche bag. :P (Even after the super profesh' letter. ;)
Greddycrx- Great job,:D now the guy can come here and read this thread. Then we're all gonna get hate mail. rofl haha.
This isn't a super serious issue, but we all should take the oppertunity to have a little fun and tell these guys that they're Rat-bastards.
When I was 19 I worked in sales at Westcoast Spoilers, but at least I went to car shows and took my own pictures of peoples' cars. I guess you could say that all these guys just sell knockoff bodykits, steal internet pictures, and never actually manufacture anything they sell. They're just middle men in a really dirty, -----d out industry.

Re:Calling All Members! Someone's Using my car on ebay

Rene' here...

Apparently there's a rash of this going around. This ass-wipe (sorry, that wasn't very lady-like, was it? ;D) stole our description WORD FOR WORD!!! If he has to steal someone else's description for his intercoolers, what does that say about his product?? I contacted Ebay and emailed him and told him to write his own ad. Here's our IC ad:

http://cgi.ebay.com/ebaymotors/ws/eB...tem=2438913139

and his

http://cgi.ebay.com/ebaymotors/ws/eB...tem=2440150668

I also put on our last two auctions that "someone" on Ebay had stolen our description - BUYER BEWARE!

Idiot...

Rene' again with an update...

Well, our so called "power seller status" got us a quick response from Ebay saying they had ended the auctions in question - um, actually, the auctions ended on their own. With no bids, might I add (did you see those krappy welds??? No wonder!)

Anyway, he listed ANOTHER ONE TONIGHT USING OUR DESCRIPTION AGAIN!!!!

Here's the offensive listing:

When worse comes to worse, my people come first. The following was sent to Mr. Douche Bag himself:

Yet another auction with another companies description. (yawn) Getting reported to ebay just for copying anothers description???? I guess that's not as bad as selling generic headers for dc headers, or a taiwanese muffler for an apex one. Hell, you didn't even spray chrome spray paint on anything this time. Send the specs of your intercooler to me, and I'll write the description for you. FREE.

*All bad examples of sales were taken from his "negative feedback" customers. ;D (insert southern drawl) "There's more where that came from, and if needed, I'll put a pop knot on his head big enough to tie up a bass boat."

Re:Calling All Members! Someone's Using my car on ebay

<in my best Suthun Drawl>

Why thank ya, Stealthmode! What a gentleman you AR!

I don't know nuthin' bout no parts (that's Anthony's department - I take care of the bookkeeping, records, order processing, etc.), but there IS a little something on Ebay called the Vero program - developed to facilitate cooperation between eBay and rights owners protecting their intellectual property rights.
So if he's claiming another company's name on these parts, he could be in a world of trouble.

What I'm afraid of (and for these other companies whose names he's using to promote his krappy products) is that our company name will end up linked to his substandard product because people will see the identical description and think we're one in the same person. That's why I added a disclaimer in our last two IC auctions that ended saying that someone had stolen our ad and BUYER BEWARE (Ebay won't allow you to actually point to the person's ID - but it should be pretty obvious).

Geez, what a tool this guy is....and I'm bummed that Ebay is not helping us more...

Re:Calling All Members! Someone's Using my car on ebay

Email sent 8):
It must be pretty hard to copy someone elses auction description to sell your junk. That must have taken you a long time. I bet you thought long and hard about what you were going to say about your crappy intercoolers. Those things look like ----. The welds look like a 5 year old made them and the pictures aren't even good enough to tell how shitty the rest of it is. You're a tool. Why don't you write your own description so you don't make anybody else look bad for selling your piece of ---- parts. Don't bring someone else down with you and your inferior parts. By the way, your ebay feedback sucks. I wouldn't buy this pile of ---- intercooler from you even if you were smart enough to write your own description. I'd hate to end up like on of the other people you ripped of by selling junk parts. You are one of the major examples of why Ebay is such ----. It's people like you that make Ebay such a loser infested junkyard swapmeet for shitbags selling garbage.

I can't believe Ebay won't do anything about it. Vero shut down one of my friends because he was selling parts too cheap. They didn't even need a reason. As long as one of the members complained they would take action. He eventually got suspended for it and hasn't been able to get it resolved. They didn't even want to hear his story. I can't beleive they won't help you. >:(
