Alright so i go to this party last nite at USC(s. carolina)...and there are about 200 kids there...i get there a little late with a bunch of my friends and i decided to be the DD. So they start drinking a lil bit playin quarters and beerpong and ---- and like 10 min later the cops bust the party. It was a well orchestrated deal...but anyway they all get away and when i go to leave a cop makes me go back in the house and they right me a ticket for Minor in possesion of beer. Which is bullshit cuz i didnt have anything to drink or anything. So i have to go to court on sept. 15 and prolly take a alcohol intervention class and pay $500.

CLIFFNOTES: I actually tried to act responsible last nite, and got fucked by the cops while my friends that were actually doin illegal stuff got off scott free.

Any advice?

Not only that, but if its not your place, and the drinks wernt in your hand. How in any way were you in possesion? You wernt. They probably used H&S 25662 - poss alch by a person under 21,

Any person under the age of 21 years who has any alcoholic beverage in his or her possession on any street or highway or in any public place or in any place open to the public is guilty of a misdemeanor.

obviously you didnt fit that, so Explain this to the judge.

That sucks. A similar thing happened to my buddy except he's actually 21. After work he walked to the circle K behind his apartments which is a minute walk. On the walk back a cop wrote him up for open container. In all it was $200, $150 for the ticket and $50 for the alcohol education class he had to take. I'm just glad that I'm 21 now and not have worry about as much ---- when I drink.

did you have a beer in your hand at all? I mean did you move a can of beer, did you friend say hold this etc.

 

Best thing is just not to go out drinking underage. Or if you do be ready to take a ticket.

 

Remember there is always 2 sides to a story.
Example: (not a true story)...
"I was drinking a beer on the street in front of my house and the cops came and gave me a ticket"

Usually the "storyteller: leaves out stuff that does make a difference. Such as...

"I was drinking a beer in the street in front of my house. The cops came by and asked me if I saw a car come by with a loud exhaust. I replied ---- u cops, youre always harrassing people for bullshit" The cops then gave me a ticket.

well the thing is...is that i had nothing to drink. I can see if i was in the wrong by having something to drink or giving people drinks, but i did none of the above. The police have no proof that i had any alchohol...nor did they give anybody(200 ppl) a sobriety test. Therefore, I think its kind of farfetched for them to give me a ticket for "Minor in possesion of beer"...sec. #4-6. Hopefully when i go to court this whole ordeal will get dissolved but im not positive on what will happen
