What should I do about this?
 
So I come outside this morning and someone has backed into my Acura CL 2.3. Trunk is dented in pretty good, tailight is smashed and the bumper is pushed in (thinking the support is damaged) and bowing out the passenger side. No note on my car.

I look through the parking lot and see the women's brand new Jeep Cherokee has a scratch in the bumper and she has the perfect line to back up and crack into me (assigned spaces).

So I went to her this afternoon and asked if she knew about it. She told me she was liquored up last night and backed into my car and didnt know it, but her boyfriend saw/heard it and told her when she got home from the bar. She doesnt want to go through insurance (i dont blame her because a police report has to be filed for that). So agreed I would go get and estimate and she said she would cut me a check.

How open am I? What are the best things to do to cover my ass? I called the cops earlier before I had spoken to her and they said it was best to talk to her before filing a report. I'm not doing anything illegal, but I need to make sure this bitch pays to fix my car.

make her sign a document stating that she will cover all repair costs and she declares it is her fault. So that way when a fat repair bill comes, she doesn't bail.

no matter what BRING THE COPS INTO THIS! or at least have her signed something agreeing to it. My friend had the same thing happen to him with a girl boyfriend and he said he would pay for it. Weeks later they said ---- off and he's not paying for ----. So have something signed or get some cop to witness it. I hate to see you get skrewed :-\

i dunno know about hidden camera, they might dismiss it as an invasion of privacy, or actually I think the recordee has to be notified of being video taped. Reasons why stores have signs that say you are being watched. Unless the meeting is in your own home then record away, even then I think you need a sign. For example when realters have cameras set up to watch during open houses, they have to have a sign.

I woulda had a tape recorder the day of the confrontation, you would have had sooo much not to worry about.

Also go take pics of her damage before she cleans it up and pics of your damage and the parking spaces. Uhhhh like go do that NOW! Don't wait long you need pics as evidence or you will be fucked.

So here steps to do:

1- Go take pics of both cars, and parking spaces, heck a video would be better. Do both.

2- Get it down in writing that she will take care of EVERYTHING. And make her sign it.

3- See if you could tape record any conversations, again so you don't ---- yourself.

4- oh yeah, have at least one witness

You need some proof, evidence, in case she bails.

my best freind re ended me a few months ago, we didnt go through insurance, he just payed the bill when my car was fixed

Just do the whole contract thing. Write it up yourself and have both people sign it, a witness wouldn't hurt either. This way you are safe. Make sure she agrees to fault and that she will cover all repair costs 100%.

The thing about getting a police report filed is, at least in PA, if no one is hurt and both cars are drivable, it is considered an "incident" rather than an "accident" or something to that regard. This means that the police dont release a report and its a bitch to get everything faxed over to insurance. When this happened to me it took a good 2-3 weeks until the officer dug up the report and had it faxed to the insurance company. Had I known I would have faked a neck injury or something.

I would give har like two days to pay in full and if she doesn't get the cops involved. if she procrastonates about paying now, she will six months from now and why the ---- should you pay cause some dumb slut got plastered and hit your car.

something like this happened to my brothers 3000gto. it was a kid who didnt have insurance, my brother popped out the dent and buffed out the other cars paint out of his. kid coughed up 2 grand after my brother went to the best and highest priced repair shop for an estimate :)

most people would be scared to not pay you especially when you could involve the police and she would be charged with a DUI also and her insurance wouldnt cover ---- for her because.

"if you are committing a crime while driving and have an accident your insurance doesnt cover ---- on your own side."
