sueing for fradulent charges?
 
so on 1/21 u went to payless shoes and bought some 20 dollar shoes..

last week my bank went into overdraft.. fee's of over 300 bucks overdraft.. and im like what the ----.. got a letter from the bank and was like wtf is this ----? 4 charges from payless shoes.. so i go to the bank and request a statement and turns out payless shoes charged my account for a total of 500++ bucks over the course of a week.. a total of 9 or so charges ------ out on 2/25 2/27 and 2/28.. i was like wtf is this ----.. so the bank tells me to hand over my bank card.. and im like.. what about my insurance payment today??? how is that going to go through?? shes was like sir just deposit your paycheck and hope forthe best.. ittl be 10 buisness days for the investigation to go through.. so im like.. well can i access my money? she said nope.. and i didnt really havea choice i had to deposit my check because if the insurance pulled the money and it wasnt there my monthly rate would skyrocket

so yea... went to the payless store and they "checked" there records and found nothing.. they didnt deny it because i have my bank statement with me but they also dont know wtf is up..

i called corprate and made sure they took down my name and number and i let them know that my entire paycheck is gone for 2++ weeks because of this and that i lost my job because of it.. (got ran off the freeway in my monte carlo and hit a 8 inch curb and busted all 4 rims and tires pushed the front suspension back 4-6 inches and threw off the camber and i dont have money to fix it because of this stupid bank ----) and that i dont have any ------- money.. this is pretty ------- lame.. also letthem know how my credit card payment is now overdue for the first ------- time because of there ---- up... overall it was 2k of my ------- money tied up in my bank account that i cant ------- touch.. 500 that payless charged.. almost 600 in overdraft fees and -------ggggg 1100 i had to deposit into my ------- bank account frommy paycheck.. so yeah kinda bummed the ---- out right now..

so what do you think about sueing payless shoes? or asking them to settle?

anyone think i got a chance in hell? how much should i ask them tosettle for???

Ur bank sucks. I had a fradulent charge one my debit card and i filled out their paper and they put the money back into my account.

holy ---- you have the worst luck i've ever heard of.

I'd not say anything to payless corperate about suing them, just tell them they'll hear from your lawyer. then pay a lawyer to send them a letter about being sued and hope they send a check.

thats what i was thinking.. but need someone to toss out some numbers.. proposed settlement right off the bat.. something theyd take me up on.. because i obviously dont have the money to take them to court.. lol

i have over 2k of my ------- money being held up for more than 2 weeks because of some faggotry that payless shoes did.. lost my job.. cant fix my car.. and got my first late payment on my credit card.. :S

yea i want a freeride ::)

im in contact with my old boss about getting my old job back which is closer to my house so maybe ill come out a winnar? doubtful :'(

who the ---- do you bank with? i would call those bastards and tell them to remove all of those charges, ---- that, i had the same thing happen when i subscribed to honda tuning a few years ago, i accidentally submitted the payment 3 times , as soon as i saw it i call bank of america and they immediately removed the extra two charges and all the overdraft fees. dude they can't do that seriously, if you have reason to suspect that there is fraudulent activity on your account they should be able to freeze it (like say someone obviously stole your information or whatever, could be someone that works at payless) i sure as hell would not have given them my paycheck, should have told them and your credit card to go suck some dick.


anyway, now that you fucked yourself, call your bank and don't let those bastards off the phone until they remove all of those charges, keep them on the phone all night, cmake tem transfer you to every manager they have, be a dick, don;t let up or they will run all over you, i'm drunk but does that make any sense?

something else i just thought of, obviously someone has your credit card info at payless and is probably charging fake ---- to your account and taking the money ( i know this because i have done it :-\) but what you need to do is go to the police station and report that you think someone there has your info and charge them(payless) with credit card fraud, the detectives will go up there and start talking to people threatening with lie detector tests and ----, basically payless will proactively work with your bank to get your money back, right now they could give a ---- less because as far as they see they only charged you once.

then you take your policia report to your bank and show them you have a legitimate issue they should at the very least return your funds and drop all charges pending a finding in their investigation.

how do you get ran off the freeway in a monte? was it a semi? dude just move out of detroit, come to kansas city, we are arabian friendly, hell you can have your choice of gas stations/hotels whatever. :8

it was a 99 monte carlo and i was on the phone and the dude merged and i swerved to avoid em into an exit only lane..

i havent gotten a moving violation in like 2 years or so.. ive become a ----- driver to avoid tickets.. works so far.. lol

i know i need to go make a police report but i dont feel comfortable pulling into a police station with a car whose suspension is pushed 4 inches back :P

i will do that tomorrow

lol i dont want to sue.. i just want a quick and easy preemptive settlement :P

not asking for alot but ----.. i lost the perfect job because of this bullshit :S

----, sue them for the full amount plus damages, just go talk to a lawyer and see what they have to say. it wont cost you anything and if they do take the case then you know for sure you will get your money back plus some.
they have this thing where they only take your case and charge you if you win, so you cant lose.

Don't go to the police station then, go to payless and call the cops, make a huge ass scene about how those fuckers riped you off and you lost your job because of it and some bastard there stole your money because your an arab.

Seriously, the cops will come and file a report, then it will get transferred to a detective and then you can follow up with them, the longer you wait the harder it is to prove they fucked you over, not to mention pays less will want you to be happy and not come back anymore, quit being a ----- and just do it.

Yeah cause a big scene. Call the local paper or something too and tell them what you are going to do. Bad publicity will make them want to handle it quick.

+1 make that ---- public and just see how quick it is resolved. However, see my above post about being sue happy and be prepared for a suit against you.

Tell them beforehand if they don't straighten ---- out you're taking it to the news, see if they'll do anything.

Even if it was an employee that fucked you out of your money, sue Payless the company. They're still responsible and are much more likely to have the money than an individual working at payless.

I hope you learned your lesson about cheaping out on shoes.
