So now she's not paying, think I got a case?

Default So now she's not paying, think I got a case?

*Update* So I send the woman a message on myspace telling here they had the car and that I would pick it up and resell if they wanted to reimburse me for the impound fees and renaming balance. Now at this point I really don't want to get the car back, was just trying to be civil and save them a few $ and not be that big of an ***. I get this in return:

"Plz..... I have almost 4000.00 worth of reciepts of all the work that I had to have done to that car.... You lied and told me that it only needed (1) Part for the computer.... I had to put a new transmission, computer, new clutch, alternator, belts and hoses, breaks, roaters....... You can do what you want.... I really don't care. If you want to go to court lets go.... I have already talked to my lawyer

So now I say screw it, I guess I'll go to court. Jorsher drove the car for a few months when he was working on his Civic. The car was fine except the possible computer issue (idle surged more than likely due to a burned out iacv port. Pretty common in these cars, but was made apparent at sell and why I discounted it.) Here is a copy the bill of sale. Think I got a chance? :1






Ok so in Oct of 07 I sold my girlfriends mom my 96 Eclipse GS for her son. Me and the chick broke up the next month after 4 years, and I have only gotten one payment since then. Supposedly they had to get a new computer for the car [which I don't doubt, I had a feeling that was the idle issue.] and a rebuilt transmission.

Well I was to the point where I was about to take them to small claims and say screw it. Got a call today from the wrecker yard saying they had impounded the car. They said he was driving with either a revoked license or no insurance and it was impounded about 2 months ago. They said that they have been trying to contact them and he finally said to contact me and find out what I want to do since I am the lien holder.

The guy said the storage fee will be about $800. So if I pay for it and get the car back, can I "sell" the car for say $1000 (say the motor was screwed) and sue them for the other$2500 (sold for $3500) and the $800 for impound fees? Her husband is a mid grade nog at Lockheed Martin making a nice chunk and the title/bill of sale is in their name so it will be going after them.

work out a deal with the impound yard so you can get your car out without having to pay to get it out

Does the bill of sale clearly state they did not pay you the full amount, and were to make payments? Was there an agreed upon payment plan/amounts?

Did you give them a receipt when they made the ONE payment that they did?

I assume you must have given them the title?

Lawyer up before you do anything if you intend to sue anyways.





The impound yard aren't gonna care honestly, They just want their money... Your best bet with them is haggling, not 'explaining'

Bill of sale just says that it was for $3500 in the form of payments. No never gave them a receipt for the one payment, matter of fact I never cashed the check. So really they have no proof of any payment. Yes I had to give them the title for them to get a tag, but I am listed as the lien holder. Not sure what a lawyer would do, I can't take them into small claims with me.

I would just CONSOLT with a lawyer to make sure you are 100% in the right

(I was gonna ask if you were on their as a lien holder, and since you are, I think you are pretty much solid in sueing them.)

In all honesty, the HMT route of saving money, get an appointment with your chief of police or some other higher-end law official who can give you some suggestions on the situation.

I watch those court shows all the time and I know I can sue them as is for the money. Being from the HMT greatness I am thinking I could "sell" the car to someone for $1000, sue for the other $2500, wait a few months, and sell the car again for $3500 lmao

+1 on that it would be your best bet. they might be able to give you a good way of going about doing it and what to say and what not to say
