Roomate problems...

7 Attachment(s)
So here's the deal, lately I have been having some problems with the girl who I rent from(downstairs of her house). In december when I moved in, she made up a "roommate agreement" contract stating a bunch of random rules... I will post pics of said agreement. Within a week of me living here, she did stuff that was specifically stated in the contract as non permissable. Now, I am moving out. She handed me a bill for 275 dollars. 200 was to cover the rest of the thirty days notice i was supposed to give, other 75 is for random bullshit. Anyways, I need someone to tell me if she can actually use this against me in court if she decided to take me to court for this sum... here is said contract...sorry for shitty pics, cell phone cam ftl

---- it, move out anyways and let her take you to court, they prob wont see a matter under $300, and if they do it will prob cost here more to take you there. just keep a copy of her demand for 275 to prove it was only for 275

Re: Roomate problems...

Pay if you are contractually obligated to do so. If you think that she broke rules and you shouldn't have to pay the whole $275 or any of it. Tell her, tell her why, and try to have an adult conversation about it. If she disagrees and states you still owe her $275, tell her you don't agree and you are unwilling to pay that amount and she will have to do whatever she needs to, to get the money she believes she is owed. Most likely the worst case scenario would be a trip to small claims court. If shes dumb enough to hire a lawyer, don't lawyer up. You are talking about a small claims court case and getting a lawyer involved is just retarded. An hour or two with a lawyer would be more than the $275 so as long as she doesn't get the money, you should be relatively pleased.

give her the 275, then come back and steal 275$ worth of ---- from her house O0

like he said, the court fees alone would probably keep her from sueing you

Re: Roomate problems...

I think in south dakota you can sue for as little as $20 and the court fees are only about $40. Id say ---- it and go to court worst that happens is you have to pay $275.

I say just take your ---- and just get out without telling her and i wouldn't give a ---- what she says!

Or just track in some of that dog ---- she don't pick up, get it all on the carpet in the common area be a big dick get her to kick you out do nigg3rish ---- thats not on the contract Have crazy people call at like 3am O0

it could be written on a napkin, if it has signatures and both parties agree to something, legally, it's a contract

although proving ---- is where it gets tricky

Sounds like you have to give a 30 day notice. What rules did she break that were STATED in the agreement?

all right lets see if that business law class i took 4 years ago can pay off, you have a contract with your landlady, although the contract says you are supposed to give 30 days notice, she broke some rule in the agreement breaching the contract.. so all you have to do is make sure you can prove this in small claims court and evt will be all good, and like the man said the best thing you can do is be mature about it and talk it out like grownups. I know people that wish they did that after going to court over a whole lot more money, what exactly did she do to violate the rules?

During my first week at my new job(get up at (4:30am), She had 6 people over(10pm-late AM next day), drinking and watching movies. Woke me up several times during the night, this was covered in the study hours section. They also slept on the floor in the living room, which was a violation of the Guests section of her agreement.

Re: Roomate problems...

Get better pics of the agreement and we'll see if you have a grievance that releases you from the contract. Also, having other roommates that witnessed her actions is a plus, however they may not want to get involved because it could make their living situation uncomfortable.

Summery: Need better pic of said contract. How do the other roommates feel?

Honest/Moral Perspective: What she did doesn't give you a reason not to pay her the fines associated with your discretions. If you want to do the "right" thing, send her a check for $150-200. Say she broke a couple of rules while you were living there and you are taking out a monetary value you associate with those issues.

Legal Advice: Don't pay her a dime. Move your stuff out and say you will pay her a couple days after you leave. Never do. She will have to take you to court to get her money, and if you don't pay after that, she will have to get a collection agency on your ass. After she gets the $275 she will still be out $40 for court fees, $100-150 for missing one day of work, and about $100-150 from the collection agency leaving her in worse off than when she started.

Now it is up to you what you think would be best. The one advice I can definitely give you is, DON'T GET LAWYERS INVOLVED.

If she breached the contract and he is moving out, why should he have to pay for the rest of the month he's not living there? We need a better shot of the contract and we need someone who is an ACTUAL lawyer to drop some knowlegeabilities in this thread.

well from watching my fair share of judge judy i can say that similiar stuff comes up on there like the whole owner/head of the apt breaks the rules and thinks they are above it. it ususally just gets dismissed, she signed it saying those are the rules and she broke them, she is in violation of the contract not you, sue her for the cost of rent.

HMT call-a-thon, ftw.

anyways, like it was stated before, if she breached the contract, then obviously you shouldn't be obligated to pay the bs 275 bux. i wish you luck, my friend

This is why my legal advice was not to have him pay and let her take him to court. My moral compass says everyone is inconvenienced at one time or another when living with other people. His inconvenience made his life suck more, but didn't directly cost him a dollar. Him moving out means an empty room which means more rent for the other tenant(s). Giving her 30 days to find someone else to live there is more than reasonable and assigning a monetary penality seems logical as if she doesn't get someone to move in because he didn't give her enough time, it costs her money.

Again, legally speaking, don't pay her and let a small claims judge sort this out if she wants to go that route.

is it really THAT hard to deal with the rules she broke for THIS ONE TIME?

i would just stay and see what would happen down the road, unless she really pissed u off

You could get ther drunk, pound her, film it, and put the video on the outernet. Not that it would solve anything but I'm sure everyone here would be down to see it. :6

And murder is always an option. :-X

Throw a few dead rats into the heater vents and after a few days that smell will be intolerable, then you could say the living conditions are deplorable and back out of the deal that way.

Rats at the pet store are like 10 bucks, you can kill em humanly by puting them in a tuperware container and puting them in the freezer.

Good luck proving she broke the rules whereas she has you by the nuts. Better take pictures before you move out too. She could go in a mess ---- up and claim you recked the place.
