PayPal trying to dick me over

Well I sold a car head a few months ago. They package got beat up by FedEx, but they denied his claim. So he wanted me to fork over a refund, even though all the parts were still there. A week later I moved, changed banks, got pissed cause PayPal had messed up some things on my accoutn and I closed the account.

Fastforward to today. I get a letter in the mail from NCO Collections saying that PayPal had turned over my account for collections. So I call PayPal and I'm like WTF? Turns out they sent it to my old e-mail address, not the one I updated to. I changed my e-mail address on PayPal, but the girl said it was showing my old one. Now I have e-mail from PayPal in my new e-mail account so why would they send it to my old all of a sudden?

Anyways, turns out the dick filed with PayPal (must have waited till his 30 days were about to run out) and they sent the e-mail to my old address. Well of course I didn't respond since I don't have that e-mail account any more. I guess hes saying he didn't recieve it or whatever. So he has the head plus the chargeback amount and PayPal says I will just have to fork over the money cause I never responded.

Oh and get this, they sent the letter to my old address that was deleted and updated to the new one also.

So my question is what can they really do? They can't take money out of my bank account without my consent. They don't have my social security number, so they can't file it and hurt my credit can they? Anyone else ever had a problem like this?

Re: PayPal trying to dick me over

Umm...they do have your social security number. Your credit will have a collection account on it, if it doesn't already. You either pay it or ruin your credit for the next 3-7 years, depending on if you know what you're doing when it comes to deleting negative items off your credit report.

How do they have my social security number? I never had to put it in when I registered on the site.

All you need to do is provide proof of shipment and show that is was delivered.

Yeah they girl said I would have to file a appeal to PayPal showing I sent it, but that they had already turned it over to collections. So now I have to pay collections either way and they would see about getting the head or the money back :l

Hmmm...I just made an account with Paypal and they didn't ask for a SSN. :l I'm sure it's there somewhere? ??? I know I've entered it somewhere in there. ??? Maybe it's with the bank account or credit card? ??? Maybe they don't even need your SSN? ???

I say consult an lawyer, if you can prove you shipped the item then he should have to pay any and all fees because he provided false information to paypal so they would rule in his favor, show proff that paypal was aware you changed your e-mail and still failed to notify you, paypal wouldn't do anything for him even if you mailed him an empty box, didn't he post pictures on line of what he recieved? I think you have enough proff to make a case against him but you need to find someone who knows the law

Re: PayPal trying to dick me over

i wouldnt pay ----. Let them know that you know they fucked up. You updated your new address and gave them new email address, They also sent confirmation to your new address. They are just dicking you around, lay your foot down! tell them your getting a lawyer yO! :6

It was before we moved. We had BellSouth. We not have comcast so I have no way of checking that email. Even so, I updated my email address, so why would they send it to that address?

I have 30 days to file a dispute with the financial service before they actually make a claim on my credit report.

Almost forgot. How does it work suing somone from another state. Do I sue them here and they have to come here or what?

jecu 03-31-2006 03:35 PM

Re: PayPal trying to dick me over

they would have to come to your state, but your claim isnt large enough ($75,000 or over) for your state to use the long-arm statute :-\ I dont know, you may just have to take a loss because its too much of a headache to ---- around with paypal and the collections agency. Trust me I have been through it and ended up losing money but I wanted it off my credit, and I no longer use paypal :3

jinxy 03-31-2006 03:46 PM

Re: PayPal trying to dick me over

yeah, it might end up being cheeper just paying for the head again and taking the loss. a lawyer, court cost, and the headache will be a pita.

Re: PayPal trying to dick me over

Here is the response email I just got from Paypal. Apparently he did a chargeback on his credit card. So they did't even give me a chance to respond. They just fork the bill over to Paypal who tells me to bend over.

We have disputed the chargeback on your behalf and must allow the
buyer's credit card company 75 days to reply to our dispute. If the
dispute is resolved in your favor, we will promptly lift the hold on
your funds and notify you by email.

When you receive a payment through PayPal, unless you follow the steps
necessary to qualify for our Seller Protection Policy, you are not
protected against a subsequent reversal of the transaction.

In the event that the sender's transaction is reversed for any reason,
and you do not qualify for the Seller Protection Policy for that
transaction, you must reimburse PayPal for the amount of the reversed
transaction, plus any fees imposed on PayPal as a result of the
reversal.

PayPal sellers are not automatically protected against transaction
reversals, such as chargebacks. If a transaction is reversed for any
reason the seller must reimburse PayPal for the amount of the reversed
transaction, plus any associated fees incurred by PayPal. PayPal may use
funds from any currency balance to recover amounts owed to PayPal for
chargebacks or for any other reason. (A chargeback, or reversal, occurs
when a buyer rejects or reverses a charge on his or her credit card.)
Pending ACH withdrawals may be canceled on the account. Furthermore, any
payments received for an account with a negative balance will be applied
toward the negative balance regardless of a member's Payment Receiving
Preferences. The above does not apply for negative balances that may
result from a pending reversal, such as in a case where PayPal has yet
to conclude an investigation of a complaint or situation

Actually no if you bothered to read the whole thread you would have known that he removed packaging material from the box to make it look like improper shipping. That was a brand new box when shipped, when he took pictures of the package the box was full of large holes. The retainers and springs were wrapped and put inside the head where the cam usually goes. Then the rocker amr assembly installed over it.

I had all kinds of conversations with him about it. Basically he was pissed that I decided not to give him a spare Y8 manifold I had laying around. So he wanted all his money back.

The other person said they didn't get their package. I don't know because the crappy shipping place I used said they didn't offer tracking to Canada. Well because they other guy lied to Paypal and Paypal sent me a message to my old email that was updated they put a hold on my account. So I couldn't send the other guy the money. I had to send Paypal a money order and wait for them to send him the money back.

Paypal also told me on the phone they sent the guy a letter saying he had to return the head. He said he never received any letter from Paypal. So so far they sent me a message to the wrong email, they didn't even send him a letter, and they froze my account and made me send them a money order for the other item.

So yes anyway you look at it the guy lied which caused Paypal to screw my account up, which kept me from refunding the other guys money. ON top of that they have $600 froze in my account. Why didn't they just take the money out of there??? No they froze it and sent it to a dept collector. Paypal sucks.

No, Doug, dealing with riceboys sucks.

BigD 04-02-2006 01:11 PM

Re: PayPal trying to dick me over

Yeah go figure most people on H-T took his side. Every package I send now get pictures taken before shipment of item, box, and packaging. The bad part was that FedEx even lost the head for about 2 weeks. Then he said it just showed up again one day. I would have denied it and filed a claim. That's BS, who knows where that head was for 2 weeks and what could have happened to it.

There was a lot of lies on his part. Like I said all my money is locked in Paypal. $600. When I talked to the guy at customer service he said once they get the money order and refund the other guys money they will send my account for review to try to get it unlocked. WTF???? Why not just take the money out of my account???
