need traffic law HELP
 

ok saturday night i was following two friends i was the last car cause my alxe broke earlier and if i took it above seventy my whole car would shake beyond control. they were doing i guess between 75-85 MPH i was steady at 67mph. We all past a state trooper but i didn't see the cop so i just kept going on my bussiness. I then see the flashing lights behind me. I flash my high beams at my buddies to try and get them to stop and what do they do. drop it a gear and take off running. MY mom just passed away three weeks ago had no life insurance and no money in the back I had to move into her house two weeks ago to help take care of my disable dad who is probally going to die soon too cause his health is worse then my moms at the time. Trooper pulls me over and says i was doing 75 in a 55 zone. I explain to the trooper my car is broken i couldn;t be doiong 75 cause my car would shake like crazy that is was my friends that were speeding and the only reason why i'm getting the ticket was cause they took off running. I tried to explain to him that i'm on probation for a speeding ticket i just got another ticket two months ago that i'm scheduled to goto court for in december and my mom just passed away and i can't afford any more. He then tells me my sob story wasn't going to work with him and that we car guys hook up our cars and think the free way is our own private race track. SO now i don't know what to do. I'm on probation for a ticket i got 7 months ago. I got a speeding ticket two months back that i'm scheduled to goto court for in december. I was just going to take that to court pay it and take the hit but now i have this new speeding ticket and i don't know what to do. Any suggestions on how i might be able tio get off or out of these tickets. I'm thinking right now to try and reschedule the court date other then that i'm lost as to what to do

For one, you're an idiot for going 67 in a 55, especially living in the DC area, especially after just getting a ticket, and especially because you drive a Honda. You pretty much asked to be raped. Cops in MD, DC, VA almost always pull over a Japanese "tuner" car when they travel in packs, that's how it is. Don't do that ----. I don't anymore. On 81 I have it pegged on 70 the whole way, and it's a 65. We have people going 90 that don't get pulled over flying by cops, but if I go 75 I know I'm getting nailed.

Secondly, go to court and explain to the judge that you had a fucked up axle and there's no way you could be going that fast because of the vibrations. Tell him you had it pegged on 55 and you know for a fact because any higher and it would vibrate.

Lesson learned: Don't speed like a cockface.

Hell you dont even have to be in a pack....or speeding. They will pull you over for just about anything they can. Even if your a girl with a baby in the car....your a streetracer to them. ---- Va cops

Yeah it's bad, and I don't really get it. There are a lot more blown Mustangs in my area capable of much more than the imports around here. There's even a shoebox in Winchester with a huge blower sticking out of the hood (the thing has to be a KB 2.8 or larger) that's about 2/3 the width and length of my Civic. The thing is nasty sounding and it has about zero chance of being pulled over.

I've noticed a lot less attention drawn to myself now that I ditched the Apex'i Dunk catback in favor of a full 3" with the muffler tucked and a downtube painted black.

The only thing that makes my car not appear stock is the exaust. Its not that loud defenatly not as loud as a mustang. I have gotten pulled over and harassed for the exaust more times than i can count but they never give me a ticket...hmmm makes you wonder right? can we say profiling????????

I don't get hassled for my car even though i have a huge front mount and bumper cut my tag is on the front and thats all that matters. MY exhaust looks stock and because the turbo helps it's even quiter then stock.

Take him to court and ask for proof you were going 75, a ticket that is 10mph less will be less hefty at very least.

I also think the whole tell them your car was broken thing is a bad idea, because driving with a known broken vehichle that is potentially dangerous to others is gonna get you in alot more trouble if you ask me....

When I got tickets I went to court. I was respectful and told the judge I didn't dispute the fact I was speeding, I was just looking for leniency (sp?) for insurance reasons, etc. I always at least got my points dropped and almost always had my fines lowered too. But the one thing I never forgot is I was speeding and was breaking the law, it's not my right to get cut a break.

I would go in there and tell them you were speeding but would ask to get ---- lowered. Maybe tell them that you think the speed trap clocked your buddies car, but I doubt that would fly. My gut says if they were going "75-85 MPH i was steady at 67mph" that you wouldn't be very close for very long. Just remember to be polite and not to be a jackass, they don't owe you ---- you need to convince them to give you a break.

And whatever you do never tell the judge the cop is lying or flat out wrong without solid proof. You just make yourself look like a jackass. It's your young word against a guy that has sworn to uphold the law etc etc. Even if the cop is a lying scumbag, hes' more credible in the situation.

yea i agree with the MD VA DC cops all beiing pricks..

mY dad was popo in MD, so i get a good break here. Been pulled over a bunch never got a ticket. but DC and VA, i dont speed, cause they give out of state cops ------- tickets, so the "my dady" thing dosnt work at all. But not speeding on the high way is a good idea...
i know you say you wernt, im just saying dont do it.

But your best bet is to be polite, and if points is what your really woried about, get a good lawyer. My bud ran from the cops, fliped his car, and crashed thru private property, and wallked away with a pbj. IT will cost 300 maby 400 $$ but think of what it will save you in insurance.

You could be going down 81 (the east coast's main north to south highway) sideways at 100mph in a Camaro or Rustang and they won't ---- with you. As soon as you fire up a Honda and go 70 in a 65 they swarm you.

two weeks ago i got two defective exahust tickets within 7 days. the first time i actually got on it and was loud the second time they were just harrasing me because i was going under 30mph and mainly just idling there. im just goign to have someone write a note acting like there a shop and its fixed. im trying to sell the car anyways

I really don't see why this is important.

You say you were going 67 in a 55, he says 75.

You really can't rely on the "my car can't go that fast" option. The only thing I could see is maybe having your speedo tested and then the judge may give you a continuance if you don't get another tick in 6/12 months. Even with that you are hoping for the some love from the judge, it is your responsibility to keep your car in good repair.

With that option you are also pretty fucked unless the test of the faulty speedo shows you as 20mph slower so you would actually be not speeding at all.

Overall just kill yourself for even asking these questions.

That's for wreckless driving, which this guy might be getting. Winchester rocks. There aren't many cops that know ---- about cars, and there's no emissions testing. Drive a half hour east and you have emissions testing in the same state, I love it. I know better than to speed in Manassas or Fairfax, that ---- is begging for the bone.

thats not for reckless driving as you pointed out... the fee for the ticket is still like 300 or something, but they now have a 1500+ court charge fee...so your normal 360 speeding ticket is now like 2k when its all said and done.... so all you travelers watch your speed, cause you could buy a new project car by the time your done

Reckless driving results in an annual fee of $350 for 3 years, on top of the original reckless driving fees and court costs. However, if you show up to court with a lawyer that knows his ass from a hole in the ground you can get the additional fees thrown out, because they're technically unconstitutional. You can't charge only VA residents and not people from other states because it's too hard to track them. That's bullshit and VA knows it. It's a way to tax without calling it a tax. It's illegal for them to do it, and 90% of the time they get thrown out if you make a stand.

Yeah I'm from Winchester but I'm in Harrisonburg now at JMU. Do they really have a 16 ticket quota per shift? That's ------- bogus.

Yup, quota blows ass. And it's a bit more than $350/year extra depending on the ticket/prior ticket. And the court system can't throw the extra fees out, because they are "licensing fees" enforced by the DMV, has nothing to do with traffic court. Henrico County is the only place in VA where you can't get them, as their court system as a whole has ruled them unconstitutional. But that is just one county :(

and they are working on a system now to get out of state drivers with the same fees, big talk in the adjoining states like MD, but all together the idea is bull ----, but hell im not going to be speeding thru there thats for damn sure.

Man that's a 180 turn from what I heard a few months ago. Last I heard a VA court was sued big time by a lawyer that got a reckless ticket the first day the act was put into action and he was working on getting rid of it everywhere.

Fairfax County cops suck ass. I got followed for a good 20min on sunday. He even ran my plates from what i could see in my rearview but when i got ready to turn to my street he went to 7-11. I have been harrassed by ONLY fairfax cops. Even the vienna cops who are bad for being stupid and ignorant dont ---- with me. But as many times i have gotten pulled over I only once got a ticket for having a out of state licence. They know they cant give me a ticket for exaust......well they could but I would fight it all the way and i tell them that. ---- cops

20 over is a common speed on most highways, for example, 83 or 95 in Maryland, traffics speed 80mph, speed limit 55mph in some parts, thats 25 over, and all your doing is not impeding traffic,

im all for the if you cant do the time, dont do the crime, but the police in VA are ------ nuts,

Whatever you say skippy. On 81 60% of traffic is fully loaded tractor trailers. The speed limit is 65, they generally go 80+. You know what I do? I cruise at 70 because I know what happens if I don't. Don't worry about everyone else, handle your own ---- like you got some sense. It doesn't take a rocket scientist to realize you're full of ---- about everyone going 80 in a 55 on 3 or 4 lanes of 95. Not everyone does it, I know for a fact. It also doesn't take a rocket scientist to realize that's reckless and unless you want to get raped you don't do it in an import.
