this is how it looks like am just windering if that oil suppost to be where it is
so far no shaft play and spins freely

There is no seal, per se, just an o-ring that more or less acts as a halfassed block to encourage the oil to fall down through the drain instead of passing it. Your CHRA is most likely carboned up and/or drain problem. I'd rebuild it to be sure.
