definitely wasn't legal, and you do make a good point agentmurdoc, but the thing is that he accepted the check and deposited it, which makes it an accord of satisfaction. in otherwords: he was satisified with the new agreement. just like making a new contract. hopefully there is more here that I/we don't know that may change that, but from the info I see, it looks as if the breach of contract was waived by accord of satisfaction. (man this business law book is coming in handy)

The check was accepted and deposited...however, the first months rent is not due nor is there any type of deposit due on the property due to us picking up a lease that was already inacted and deposit paid in full(rent is due at the first of april, the person who leased the property before us paid the rent for the month of march, we took over that lease and the payment already made) We took control of a lease and became the new leasee...Until rent is due...they are still in breach of the contract at hand. And...on top of that...they have stated they are going to change the locks on the doors on saturday...that leaving us a 3 day notice of eviction...also, in the lease...~"any property that is hereof or thereafter becomes the newly deemed controling parties to gain proceeds from to compensate for loss of rent or damages"~...IE...any of our ---- we are unable to vacate before saturday becomes the property of the realistate agency and the owner of the property...They are breaking the law...and we are refusing to get the shaft

change the locks yourself so they are locked out :P
