I know you didnt roll back into him. But for arguement sake lets say you did. You'd still have to roll back 1 FULL car length for it to be your fault. Because if you rolled back 2 feet and hit his bumper it's his fault for "following too closely".

Call his insurance company back and ask why they are denying payment.

i've got state farm and they are the best by far (i work in the rental industry). however, when i had my deal that the stupid ---- tried to run they wouldn't pay out at first because his company is also state farm. if he denys fault or tells his ins company to not pay, no matter who it is they won't until there is evidence that their insured was at fault. they aren't out to just pay off every claim that is filed...only the one's they are responsible for. get your evidence and go to the claims adjuster or agent that is handling it...if you get nowhere go to the supervisor...if that doesn't work go to the insurance commisioner.

well first off, get ready for court my man... if your really intelligent youll make a settlement with his insurance company... it should be pretty simple... if u were in traffic there is no way u could have rolled back fast enough from that short a distance to do that much damage.. and if u take some pics which suggest he hit u by the angle of impact those might help. If the police charged him then the insurance company should be on ur side... however sounds like a shitty situation, but u might have to sue his insurance company and if hes gonna be an ass about it... sue him directly in small claims.. i have a lot of experience in court
