Default Help writing dispute

Ok so we moved out of our Apartment around the middle of May 07. I gave them a 30 day written notice around April 20th stating we would be leaving. One of my room mates spilled ---- on his carpet and had a sword hole through the door (which I was on the other side of that he was taking stabs at me drunken).

Anyways, so we weren't expecting the deposit back from that, $250 if I remember right. Well now they have sent us collections notice saying we owe $345 on top of the $250. They are saying that they had to clean up and owe another months rent because we didn't turn the keys in on time. Which is total BS since we turned the keys in before our 30 day notice was up.

Well they towed my Eclipse and my room mates Teg right after we moved since we didn't have anywhere to get them right then. His tow/impound bill was around $500 and mine was $400. I'm no doubting disputing this $345 debt, since if that was the case that we have to pay another months rent our lease wouldn't be up till June which they had no business coming in to "clean up" and tow our cars if we were still legal residents.

So my question is what exactly should I send to the debt company and what should I send to the apt complex. I have only done this once before when Cingular tried to dick me over and just said I want copies of the bills which the couldn't produce and I got off.

I would like someone to give some advice on this...

They either:
- Towed the vehicles before the lease was up and owe us money for the impound fees
- We don't owe money for the "rent" they say we owe on

what are the repercusions (sp) of just not paying it? Send a letter saying you refuse to pay for something your security deposit shouldve covered. Tell them next time they need to take a higher deposit lol.

It's on our credit reports, and I'm trying to clean mine up.

Not sure who to contact about it since the collection has already been sent to the collection agency. They don't care if it's legitimate or not, because they paid for the collection.

Well we can dispute it in writing and they have to research it. I'm going to send a notice to the apt and tell them what is going on also and let them know if they plan to make us pay the extra month we will be suing them for towing fees and illegal entry into the apartment.

doug you have the right idea they towed your cars and entered your apratment without notice so they are technically in breach of the original contract/lease therefore you dont owe them ----, and i may be mistaken but i think they actually owe you your deposit back,for breaking the lease but call a civil lawyer they usually will give advise no problem

There are federal and state laws that matter to them.

Go to Creditboards.com/forum and look around. You should find more answers for dealing with a credit collection company.

It sounds like an either or thing. If they are still asking for another months rent owed then they technically should be allowed to have their car outside and their apartment not gone into. If they don't owe the extra months rent then yeah they abandoned a car and had it impounded the right way.

yeah. what he said. That's fucked up. Either you were there another month and you had to pay for it, meaning you could park there, or they towed your cars away meaning you didnt live there anymore. Can't have it both ways.
