Girlfriends traffic ticket

Hey just need some opinions. My girl comes home upset cause she just got a traffic ticket. Well ive never heard of anyone getting a ticket for what she did so i was wondering do any of you guys have any experience with this. Here is the whole story from my understanding. My girl is trying to pull out of where she works, and there is no traffic lights. Its two lanes going one direction and two lanes going the other direction. If she were to turn right its easy to see traffic because your looking down hill, but she has to turn left which means that the traffic going the way she needs to go is coming up over the hill. You can barely see the traffic she has to pull into. So today when she was pulling out of work she doesnt see anything and goes for it. Soon as she gets in the first lane going her direction a cop pops up over the hill right behind her (she said he had to be speeding as fast as he came over the hill ). A couple seconds later he pulls her over. Well the cop ended up giving her a ticket that says NEAR COLLISION.There was no collision but what the ---- I thought when there is a collision where someone hit someone from behind its the persons fault that hit the other from behind. I know it might be hard to under stand but this is what happend and i personally think its bullshit.

just ask for a court date and explain it to the judge. it will probably get dropped

sounds like bullshit, but i know in that situation that when you pull out across lanes like that you are supposed to pull into the farthest lane to the right of the road. as in if she took a left into that left lane of that side of the road, shortly, and saftly she should have moved into the right lane, if not right away. just incase someone is traveling in the left lane, but i dont think thats an actuall offense, let us know how it goes :l

p.s. go and read the code books at your local library.

Re: Girlfriends traffic ticket

it's not always the person behinds fault, and yes this is a fact :P

i got in a wreck about three years ago i think, i rear ended some chicks in a camery, but it was put as a no fault accident, they werent at fault (which i think they were) and i wasnt at fault because i didnt have enough time to react

they slammed into a wall on the side of the freeway and totaly fucked up there car, i spun across four lanes of 5 o'clock traffic and in front of a semi and hit the barrier

the thing that caused the whole accident, they hit the brakes really fast for no reason i could see (and belive me i looked because i knew i wasnt going to stop in time, so i wanted that info before hand) i got no citations or anything

now back on topic, lol, that ticket is bullshit, take it to court and i bet it'll get dropped quick

Going from your girlfriends version, through you, and to us, there's probably more to the story.

Near collision just sounds like a bullshit ticket, but whos to say she didnt pull out into traffic like a grandma and take her sweet time doing it?
Im sure if you select the option for court, it will be dropped. Near collision.....pfffft

My girlfriend drives like grandma? Yeah right! She scares the ---- out of me sometimes. Im constantly telling her to slow down when i ride with her. Anyways yeah she gonna take it to court and explain. Ive also read that if the officer didnt show up in court that it could be dropped. Is this true? If so ive had to pay for tickets when the officer that gave me the ticket did no show in court.

Why doesn't she just take a right and find a safer spot to turn around. Shes going to end up getting nailed there one day and it will be her fault, not to mention getting t-boned in the door could likely kill her.

Re: Girlfriends traffic ticket

its true. if the officer who issued the citation dose not appear at court, the case gets dropped. b/c the state has no proof that the alleged violation occurred 8)

you get it ?

I thought you're suppose to pull in the closest lane, that would make alot more sense. Even thought the left lane moves faster, or is suppose to, getting into the left lane would be much easier and less dangerous than crossing that extra lane of traffic.

I don’t know. I live in IDAHO, I was just in court a few weeks ago and the prosecutor was just letting people go because the officers didn’t show up. if I was you i would just go to trial and see what happens, b/s the state cant prove anything.

That doesn't fly in New York, they just have to have a statement written and give it to a buddy...

In Washington the cop can be requested, along with witnesses, specialists, radar guys, etc, but they changed the law awhile ago by saying that a police report is a good enough statement. You need to get the police report before you go to court. Maybe there was a car traveling in the opoosire direction that she pulled in front of... "near accident" doesn't have to mean with the cop. However, that sounds like a ticket that can definently get dropped. Don't go into court saying the cop is wrong because the judge with say,"officerXXX has been trained to make accurate judgements." You need to say that he couldn't see over the hill, or there was a car in between and too hard to judge... Something like that. P.S. read that code on the ticket and get some details.

7 for 10 in court baby!!!

was she making a left hand turn or a right hand turn? cus if she was making a left and spedout infront of cars, or she simpley went slow as piss across the road, then yeh thats understand able. but making a right you have the right away. my friend got a ticket for making a left and not having the right of way and almost causing an accident.
