well i will try to keep this as short as possible.

my mom calls me and tells me my dad called. he said i was getting college papers at his house (in florida), so he sent them to my house (in ohio). she opens them (i am at school right now). tells me it is a collection agency. i am like "wtf?!?!"

well i call the agency. they said they have a bad check from me. i am like.. i dont write checks, they told me my name was on the account.. i am like... ummm.. ok?

well i find out that my dad opened an account for me. and he passed a few (i have ten pages of) bad checks in florida, and since he cant/wont pay for them, they are coming back on me and my credit.

i called my attourney but have not found out anything yet.

this is great, i have college loans that i have to apply for each year, and i wont be able to get them with bad credit.. and i have good credit with "MY" checking account.

my dad is social security from a car wreck a long time ago, but i cant believe that he could do this to me.

i cant sue him, because, i wont get anything. i will be wasting my money.

anyone know of/ or have had this type of i guess "identity theft" happen before?

oh.. the account, they never sent any statements to me, always to my address in florida.. which i never lived at. i dont have an atm card, account number.. anything for the account. the only way i could get my name off of it was to close it (which i did friday). but all the damage has been done... a list of bad checks... :(

That sucks man. If you can prove that you didn't write them then you can get them off your record, nothing is really *permanent* if it's invalid.

i think it is time for a road trip to florida...

there are some douchebags i wanna ---- up down there too so if you pay for half the gas i'll swing over to OH and pick you up...

there's a service that cleans up credit reports. there's an office in miami. there has to be one near you.

His Dad probably set up the account in both their names, alot of parents do that so they can help budget their kids money in college. But legally you have to personaly sign at the bank to have your name on the accountn so you might have something there- if you never signed.

you COULD actually sue your dad. If he gets social security, they'll garnish his income till the suit is paid off.

also, he could do time.

personally, id make it a point to shoot my dad in the ass with a pellet gun once a day, just to make myself feel better.

well guys.. i guess to clear up any misconceptions.

the account has my name and my dads on it. it was setup up when i was like 15.. it was to "save money for me" ha what a joke. well i never used it, and i didnt know that i could... well i dont have an atm card.. or checks.. so.. how the hell could i get into it?

i have my own account for school/work/whatever. which has my money in it.

the one my dad has.. he used checks and a debit card.. and the checks where returned and now the collection is looking at my name to have me pay.

my attourney said i might have to pay the debts, and then sue my dad. i am not sure i can garnish his wage or anything. he alredy owes me 300 for a transmission he bought, and like 700 in back child support, which my mom will never see.

its just kinda shitty to get these letters in the mail and now have collections hoovering over me.

good point: its not on my credit history yet.. and if i payed it, it wouldnt go on there. but, if i pay it.. i think i am going to ask the whole family for help.. so all of them will be pissed... lol.. no, i will probably see what i can accomplish with my attourney.

but thanks for the offers... from well... it seems like "excentric" people that want to help ;)

sorry to hear that man. i'm not sure how things work in FLA or Ohio, but up here you can call the credit agencies (Equifax, etc.) and ask them to attach a note to your credit report, and mark the bad credit entries with special codes. They won't be removed from your credit report, but they will no longer apply when getting your credit scored by a creditor.

I talked to a credit counsellor last year over a screw-up on my credit.. The talk with the counsellor was free and it was all sorted out within days.

im not sure if they can hold you responsible because you signed it at such a young age.

I think you have to be 16 to sign a legal document.

you can sign a document as long as you are of the 'age of majority', which varies from 12 to 21 in the US, depending on the state. In the case of bank accounts though, as long as it's in your name, you are responsible for it.

What he should to do is get in touch with a credit counsellor (possibly a lawyer), and close that bank account.

if you know the account number, close it immedietly, or at least remove your name from the account. That will stop more charges from piling up.

you seriously need to go down there and catch this fucker face to face ...

how big are you and how big is he? like could you roll him if it came down to it?
