ever sued somebody?
 
I think I may have to file my first lawsuit. I don't know if you guys remember but I bought that 99 intruder for $1100 which is $1100 under the lowest book value. I thought I was getting a great deal, the guy said his brother had him storing it there for him and it was sitting there for two years so his brother transferred it in his name and told him to sell it. Well when I went to look at it, it was'nt running, he did'nt bother getting it ready, I bought it towed it home and put a new battery in it and it runs now, it missfires on the rear cylinder cause the carbs need cleaned. Anyways he did'nt have the title on hand either so we made a bill of sale stating that I had paid for it and that he was sending the title. 1 week goes by no title, two weeks no title, three weeks no title,( I had called several times with no answer or call back) fourth week he finally calls back and says he accidently sent it to the wrong address and it was on its way, a few days a later I get it. Well I look at the title and it was never put in his name he just signed it and never transferred it, its not even notorized from where it was signed into his name. I don't think his brother ever wanted him to sell it he just wanted it out of his garage. I call the dmv to see what I can do, I live an hour away from him as well and they said it would first have to be put in his name and transferred to mine. Also the bike has to be at the dmv to have the title transsfered. But heres the kicker since I live an hour away and have'nt fixed the missfire yet I"m not about to ride it up there or rent a truck and drive it up there. I also don't really trust him to drive down here and pick it up, go transferr the title and bring it back to me. It would take an additonal 4-5 weeks for him to get the title back as well. I tried calling the guy three times today and he did'nt answer. Is there anything legally I can do if he does'nt give me my money back. I feel that I deserve more than what I payed since I have put a little bit of money into the bike already in fluids and maitnance items, such as the battery, plugs, and gave it about a 5hour detail. Also for him giving me the run around Sorry for the long post just wondering if anybody knows what I can do

please tell me you didnt pay in cash?

get the police involved.. if your worried about waiting 4 weeks for the title how long you think its gonna take to sue?

also i wouldnt ride that bike up there even if it did run like a top cause if it gets impounded skinnye = OWNED..

you think you got dicked? haha you should see my crx that was "running before it was parked" rofl :'(

id ccall the police and ask them for advice also if this kid has parents/uncles/aunts dunno how old he is tho.. get them involved too let them know what he did so he doesnt dick them arround the way you did

i wouldnt have bought the bike without title in hand :-\

I would probably say that you are entitled to getting your money back for the amount you paid for it, including the battery.
Just go to your local court house and for $15 file a claim in small claims court.
Ask them any questions if you have any.
BTW I sued a local Honda dealership and I won after going back for a few times due to defendant postponement.

LOL @Buk...kinda sounds like my T3 that only had slight shaft play wrong with it. Oh well, gotta bite the bullet on that one :3

Please tell me you had the bill of sale notorized...if you did, you def. have legal leverage. He'll have to either come through or refund you in full. Even if the bill of sale wasn't notorized it might hold water in a small claims court. Is there any way you can get ahold of the dude's brother to try and find out completely what's going on? That might shed some light on the scene as well. Good luck either way though.

its America you sue who you want when you want. but damn that sucks. im always carefull not to buy a car without a title. i did once but there was no money transfered between me and the guy haha. tell us how it goes. probibly in about 2-6 months. nah i never sued anyone but if its anything like regular court it will probilby take that long.

I did pay already in cash but thats whay I got the bill of sale for we each got a copy and I had two people with me to witness it. My older brother and dad were there as we filled it out and bought the bike. My dad was picking up a 72sportster that he bought off of ebay in columbus and he rented a truck so I got my bike brought home for free since it was just south of cincinati. Thanks for the help I was gonna call the police but I'll try giving him a call tomarrow if I get a chance or saturday. His brother moved out of state and has a different address so I can't get ahold of him. This sucks I just want to ride the bike, I was gonna take it to get it running right since i don't have the tools to work on bikes and I don't know anything about carbs, good thing I held off. Thanks for the comments I go hotrexed on this one

Simple, he owes you a title. In Minnesota you can do an "incorrect buyer transfer," which is how I got project slut. Steve never put the car in his name, so it went straight from Ryan, through Steve, then to me. You should be able to do that, if bumfuck Kentucky isn't gay like that.

dude sounds like my old bike
went to pick it up and he had the title but it was not in his name. but the suposed owner before him had sined it but left the new owner blank. so he just put my name on it. we didnt need it to be at the dmv or mva to do that. but i live in md so. either way hope it works out. if not fire bomb his house >:D

heres the easiest way to own it, put a lien on it and in 34 days, its yours. and even if he did come pick it up, he has to pay storage plus towing plus hookup yadda yadda, im sure you could get more than 1100 :)

its a fucked up way to do things, but the way i see it is he fucked you, ---- em right back. also if you do file a lien and claim storage fees you could legally sue him for the fees after the lien is up and its yours.
