"OAKLAND, Calif. (AP) - An attorney hired by the family of a man slain by a transit agency police officer early New Year's Day says the victim was shot in the back while lying on his stomach waiting to be handcuffed.

Attorney John Burris says 22-year-old Oscar Grant posed no threat to Bay Area Rapid Transit officers when Grant was fatally shot at around 2:15 a.m.

Agency spokesman Jim Allison says the officer's gun went off while police were trying to restrain Grant at BART's Fruitvale station, and that he was not cuffed. Allison says it is unclear if the shooting was an accident or deliberate, and that the agency is investigating.

Burris was hired by the mother of Grant's 4-year-old daughter to investigate the incident. He says the Alameda County district attorney should investigate, noting that the officer had a stun gun as well as a firearm.

The unidentified officer is on administrative leave during the investigation."

Should have given the officer TWO guns (and the stun gun), then he wouldnt have shot him. :)

if the guy already shot one guy then stole a car, I believe death is fine for him. He is going to do what it takes to get his next lit of crack, might as well put him down.

cops are nothing more than road security, and thats how i treat them. there idiots that have had guns at there sides for a good deal of there careers and many dont get to use them. they get all hyped when they get the opportunity to pull it, and they ---- up. they should treat him as a citizen of the U.S not someone special cause hes a cop. if anyone of us were to "accidentally" shoot someone, we would be in jail. im biased against law enforcement though and the system as a whole, so my view is skewed. :S

I've had nothing but good luck dealing with cops, but I agree with your view. If a cop shoots an unarmed, subdued man in the back he should have no special treatment because he legally carries a gun. Hell, lots of peole on this site legally carry, but they would fry if they did this.

I didn't see any evidence that would cause the cop to fear for his life... he just wanted to shoot someone.

the bottom line is these disgusting little tyrants were there because of a fist fight, they were arresting people, threatening people, pointing guns and tasers are people... because they had a fist fight.

this guy died because he got in a fist fight, and he also committed the crime of "contempt of cop"

Let's not forget the cop that decided to bow the bike rider fag over.

As much as I dislike those assholes riding on the street slowing me down (bikers), cop was being a complete douche, and regularly get away with it. I've seen so many cops breaking traffic laws, but I'll be damned if my seatbelt is unbuckled.
