My opinion... the deposit is as good as yours.

Why?
1. For example, when you get a your gas hooked up at home and they request a deposit. Only when the contract is COMPLETED do you get the deposit back. So in this case, when buyer comes to pick up the car, pays the 1.5k, he would get $300 deposit back.

2. Going with the above, he did not follow threw with the terms that was agreed upon, meeting up on "X"day to pick it up. Didn't show up. Violated terms agreed on, forfiets deposit.

3. Agreeing to the amount of 1.5k to buy the car, and then 2 weeks later tries to get it for 1200. That's shitty. What he shoulda done was, "I still wanna buy the car, but I don't have enough money now, here's more to show I still want it and I'm not wasting your time."

4. The car is a ------ steal at 1.5k, you shoulda just fucken shipped it to me and finance me, cause I loves that car I wanted to buy it when it was for sale in socal, but was poor then too.

As much as I feel for the buyer, if deposits worked the way he wanted I would make deposits for all sorts of ----, and then back out. Unfortunately things don't work like that.

As much as I feel for the buyer, if deposits worked the way he wanted I would make deposits for all sorts of ----, and then back out. Unfortunately things don't work like that.
should of did a bill of sale or something,could paypal really do something?

I would never give a buyer that I don't know/trust the bill of sale BEFORE paying for the car in full, so I highly doubt that stillnoturbo gave him a bill of sale.

As the only thing paypal can do is reverse the payment I guess, but they can do much. Paypal truly sucks, for both the buyer and seller.

Keep the damn money, or agree to give half of it back. At least you get something, and he gets to buy $150 worth of crack.

I read this exact same story on another board, posted by girl who said her husband was doing all the work on it and had sold it onn another forum...

Did you end up selling the car? If so, refund the money. Call it a learning experience, next time specify that it is non-refundable. If you didnt' sell the car, refund half the money to make him go away. That's more than alot of people would do and he's the dumbass who wasted your time on this deal. Time=money.

I thought the whole reason behind a deposit was to ensure that the buyer was going to purchase the vehicle.

Why in the world would you refund it? That nullifies the whole point of a deposit. Why even have a deposit if you can just get it back at any time? There would be absolutely no point to a deposit if that were the case.

It's not the seller's fault that the buyer couldn't get his ---- together and put money down on a car they couldn't afford.

If I were you, I would be sensitive to the buyer's situation and probably give most of it back, but not all of it. After all, you lost out on another sale and now you have to relist it. I would take those lost opportunity costs and relisting fees out of the deposit and then give the rest back to the buyer.

I can't remember specifically but I'm almost certain that you can legally keep the full deposit. But, that would be kind of a dick thing to do.

thats right time= money. keep it if anything he fucked you. yeah it would suck if i was the buyer and i couldnt get my money back. mistakes haapen but it sounds like some dick that was trying to hard to get something he knew he couldnt. i say take the money and invest in some hmt stickers and pass them out to all of us

he shouldnt get the money back, like you said you had to take the car off the market and pass up potential sales......now would if you try to sell and and no one will buy, then the guy cost you $1500. if he was unsure of the meaning of a deposit...then he should of tried to have you clearify it for him.



BOTTOM LINE...............the deposit is yours
