OK Ill make this short for you guys.
Bottom line I need advice on what to do??!?!?!
Im in Charlotte NC so the laws may be different

I was sitting in traffic and rear anded by a pick up. He hit me at like 20 mph
the rear bumper is shifted in about an inch and a half.
I got out and saw the damage and he suggested we pull off the road.
I saw we were backing traffic up FAST. so I agreed. I pull off and he guns it! So I pull back on a chase him flashing lights and he would not stop. I called police and they finally stopped us. He told the cop I rolled back into him and his truck wasnt damaged so he told me I could leave.
He was charged however with hit and run.
well I got 3 estimates the lowest is like $480 and filed a claim.
His insurance company called me today and told me they are DENYING payment.
What DO I DO?
he hit me I didnt ROLL inot him there was a slight incline but not nearly as he made out

Sorry to hear about your luck but I hate nothing more then dealing with insurance companies. I'm no lawyer but I think if the guy was charged by the police then his insurance company can't deny payment. You might want to talk to a lawyer or mayby start by contacting the cop who charged the guy and explain him your situation with his insurance company, he mayby be able to help you.

yep, I'd just call them back try to reason with them and kindly and non chalently (sp?) throw in the word's "court", "lawyer", and maybe someting about your back...

If he was cited for hitting you, his insurance can't deny payment. Only thing his insurance can do is lowball an estimate from "their shop" for you.

Time to hire a lawyer, and sue his insurance company for damages.

If you can get a mechanic or body friend to say that the car is unable to be driven to work or that its been running even worse causing you to be late you can sue for punitive damages to

But seriously, they can't deny payment unless in your state liability isn't required.

similar thing happened to me, but the guy got a ticket. i also suggested that i get copies of the 911 tapes of me chasing this guy down while i was talking on 911. once they saw the police report they cut me a check right there and said screw him...he was denying it and of course they have to back him up until they have proof.

I hate insurance companies. I haven't had insurance for almost 4 years. I hate insurance companies with a passion. I can't stand the fact that you pay those ******* all year long for nothing and they happily collect your hard earned money. Then, when you need them to supply the service that you have been paying for they want to argue about it and deny your claim. ---- that. That's just as bad as a scammer. Mother *******. Don't get me started on insurance companies. It's a ------- scam. The government is also in on it because all of the sudden we are forced to buy this so-called "insurance" from these so-called "insurance companies" because the stupid *** government forces us to do so. Well I say ---- that and ---- them. Anytime I hear about someone scamming insurance companies it brings a smile to my face. You need to fake a serious injury, but don't be stupid about it. Look it up and freshen up your acting skills. Whiplash is known to settle in days after an accident. You could pop up with major back pain and miss some time at work because of this. Work the system that you have paid for.

Get in touch with your insurance company first, if they can't do any thing get out your yellow pages and look under state goverment for your state corporation commission insurance fraud division. This is the goverment agency that makes sure insurance companys don't try to screw people who are ignorant of the law. I have done this several times and it scares the ---- out of the insurance company when they find out, they don't want goverment auditors in there ----!!! I would tell this guys insurance company you called the SCC, give them the name of the person you talked to and let them know they will be calling to discuss there FRAUDULENT ACTS. You will have a check in no time. The best part is it's free, put your goverment to work for you.

No offense but I love my insurance company. State Farm is the ----. I got hit by a tire tred flung in the air by a 18 wheeler and they didnt even ask any questions, they just told me to go to the shop and drop my car off and they payed for everything (even the 2003 grand am rental) O live in rocky mount,NC. All you have to do is go to the D.A. and tell him what happened and everything will be straight. I have a great lawyer that hooks me up and if you have a good lawyer I suggest you yo get him to appear in court for you.
