i just got in an accident with my FJ and i haven't really been involved in a rear-end collision before. anyways, i was doing speed limit on the 91w in the fast lane. all of a sudden traffic came to a stop. all of a sudden i heard a crunch...skreetching/locked up tires and another crunch. so i'm not liable for anything (two cars hit me, thank god). the damage isn't that bad, prolly not even post worthy. the bumper skin is pressed into my tow hitch (if it wasn't for the tow hitch it'd prolly be much worse), my spare tire got tweeked to an upright position, rear view mirror fell off, 1 a/c vent broke (gf bracing herself) and my CD changer wont play or give me my cds back, the frame may possibly be damaged but unlikely. we went to the doctor and did the whole deal. so far insurance promised to buy my son a new recaro baby seat so far and their sending that check.

now my questions are...

will they make me replace my rear bumper with a factory one?

and if i can get an aftermarket one for cheaper will they let me substitute?

will each of us in the car be compensated for medical stuff?

is it illegal or unprofessional to have my body shop "help me" rake?

overall....How do i get the best compensation out of my loss?



btw my neck and back have pains i've never felt before, my 16 month old son seems to be okay, and my breezie feels the same as i do. but WE'RE OKAY!

Yeah in my case it was I took my car to a body shop to get a written estimate and then gave that to them and they just cut me a check or if their really fussy they might write out a check to the place that gave you the estimate. Luckily they just gave me a check for some hail damage that got done on my old Volvo and I just cashed it and spent it on other ----. lol. Funny thing is when I sold the Volvo the guy didn't even notice the hail damage on it.

yea they will cut you a check for everything. weather you use the money for what they wrote you the check for or not is up to you

Thats sucks. That hapend to me recently in the Cherokee but I was sandwiched between two F250 at 30mph. the guy in front got cut off and slammed on his brakes . The Jeep came out like a champ though. Only the front bumper got damaged by the hitch of the truck in front of me. The rear scrathes buffed out and was saved mostly due to having my ballhitch on still. That went through the truck in the rears frame and rad .

Insurance told me I had to pay for the front damage. It wasnt even worth it so I didnt find a claim. But Jago is rite. they will just cut you a check for the damage. Make shure you are there when the adjuster makes his assesment though. Otherwise youll get fucked. Now your medical is limited to the other persons coverage.Most people only carry $5k in medical bills which isnt ---- for coverage.

Glad everyone is ok though. Especially the little one.

That kind of depends on if you are the lien holder of the vehicle or not, if you aren't they make sure the work gets done so the vehicle value is as much as it was before the accident, so they have some sort of collateral.

any time I have been in an accident they have cut me a check and said do your thing but I did have to sign something saying the car would be repaired, because I still had a loan. I have no idea about the pesonal injury ----, but as far as getting more money for repairs, you have to have a body shop find something damaged that the insurance adjuster didn't see. But most shops wouldn't have a problem using an aftermarket bumper if they were putting it on because the insurance company said they have to do the repair. But if the other persons insurance company tells you you have to use their shop tell them to get bent you are not at fault and someone damaged your property it will be fixed how you want it to be fixed.
